my 2014 Kia Sorento is having a paint issue and I know their is a class action law suite to get repaired. The only complaint I have is the white pearl paint is chipping off the front of the roof and on the left and right sides of the windshield . Organization Under Complaint: Hutchinson Kia, [XXX] Complaint Summary: The dealership is utilizing unfair and deceptive financial gating practices to avoid its legal obligations under a federal safety recall. The dealership refuses to look at or evaluate a vehicle subject to an urgent fire-risk HECU safety recall unless the consumer first authorizes a $189.00 diagnostic fee. The dealership refuses to give a firm, legally binding commitment that this fee will be waived for a confirmed recall component. Instead, they require the consumer to assume all financial risk upfront, stating the fee will only "likely" be waived based on their own internal, unverified findings. This creates a high-pressure trap where the consumer is forced to sign away financial rights to access a free, federally mandated safety remedy. The dealership is weaponizing a acute shortage of independent import and specialized repair facilities in the Macon, GA market. They are aware consumers have almost no local alternative venues to get an independent, affordable cross-check scan, and are using this regional monopoly to coerce consumers into signing open-ended diagnostic authorizations. On XXX, the 2.4L Theta II GDI engine on our 2014 Kia Sorento (current mileage: 160,000) catastrophically seized without warning while my [XXX] was driving at interstate speeds at night. This caused an immediate and sudden loss of power, power steering, and braking assist, creating an extreme traffic hazard. No one was injured and the driver was able to safely coast to the shoulder, but it created a highly dangerous situation on a busy interstate. We had the vehicle towed to an independent mechanic who pulled the starter and confirmed a total mechanical engine seizure. The vehicle was then towed to a Kia dealership. This vehicle has suffered from the well-documented Theta II factory manufacturing flaw where debris destroys the connecting rod bearings, leading to high oil consumption and sudden highway seizure. Severe paint delamination has occurred on my vehicle, causing the clear coat and base coat (Snow White Pearl color) to come off on the side of the hood, pillars, the doors, and the hood of the car. Not only does the peeling paint create an airborne/debris hazard, it also risks exposing the vehicle to premature rust/corrosion. This issue slowly began not to long after I bought the car in November 2024, and has only gotten much worse. From the information I have gathered online, this is a widespread issue affecting this particular model/year/color of Kia. We need something done about it asap!

The vehicle's original engine suffered severe oil consumption and a blown head gasket, which contaminated the exhaust system. The Kia dealership replaced the engine under warranty but refused to replace the damaged catalytic converter claiming it wasn’t a part of the warranty even though it was consequently damaged. The dealership explicitly stated the vehicle should not be started or driven due to the blocked exhaust, but then did repair and release after I pushed for the catalytic converter replacement. They said I would have to follow up with Kia corporate. They released the unsafe vehicle anyway and I have been following up with Kia customer service for 2 months to request a CAT replacement. While driving, the blocked exhaust caused a severe rattling noise, immediate engine overheating, and complete mechanical engine seizure. The engine completely cut power and locked up while in motion, creating an immediate crash hazard on the roadway. The vehicle is now completely inoperable and will not turn over. This is a severe safety defect where a known blocked exhaust system directly caused catastrophic engine failure while operating.

The paint on my 2014 Kia Sorento (Snow White Pearl) is peeling and delaminating across multiple areas of the vehicle, including the roof and side panels. In several areas the paint has detached completely, exposing bare metal, and rust has begun forming on the roof. The condition appears to be progressively worsening and does not appear consistent with normal wear or isolated paint damage. The affected areas are available for inspection. The peeling paint may create a road or visibility hazard if pieces detach while the vehicle is in motion. In addition, the exposed metal and developing rust on the roof and upper body areas may affect long-term structural integrity over time. This appears to be a widespread issue affecting similar Kia Sorento vehicles with Snow White Pearl paint.

To whom this may concern: This is what I sent to KIA which I was informed to contact KIA customer care via phone. Which I will do but I know of several people that have had the same issue as me with a Sorento. I am writing this in regards to my 2014 KIA Sorento VIN: [XXX] I purchased in November 2021. At time of purchase it had 89199 miles, I kept up routine maintenance as usual then May 2022 while my husband was driving down the interstate the KIA shut completely down. He tried to start it back and seen a warning display on screen. We then had it towed to KIA in Morristown,TN for them to inform us that the motor needed to be replaced. That this was an ongoing issue with this make /model of vehicle. Luckily I had extended warranty that I purchased through Farris auto when I financed the KIA. They covered the replacement of the motor with 65000 miles along with a couple other things at that time. So the replacement motor was installed by July 2022 I haven’t had any issues with it until September 2025 I had the exact same thing happen to the second motor that happened to the first while my husband was pulling into driveway. I tried contacting the warranty company and of course there was nothing they can do. I contacted KIA in Morristown TN and Knoxville TN spoke with someone in the service department and nothing they can do. For this to be a known issue with Kia Sorento why can I not get the motor fixed? I don’t know where or how to find out if the motor that was replaced is in the recall list but it seems to me that KIA as a company would stand by their product. Car burns oil to the point it requires 1 qt/500 mile. Had oil consumption test when issue first started in 2024 by kia, was told there was no problem. Car has continued to have this issue and has now broke connecting rod due to engine starvation even through the oil is to the full mark. I lost all power while driving with no warning before hand. Kia has admitted these engines have oil consumption issues that can lead to this exact problem and many other consumers have complained of the same situation in which Kia will not replace the flawed engine.

My 2014 Kia Sorento EX was purchased brand new, one owner, and started losing paint in several areas on the outside of the car and is horrible. So many 2014 Kias have this issue. It is a BAD PAINT job. This should never happen and I’ll never buy another Kia. Kia should fix these issues immediately. My Kia is in great shape except for the horrible paint.

Re: Formal Complaint – Repeated Engine Failures and Unacceptable Service Delays Vehicle: Kia Sorento 2014 VIN: [XXX] Purchased: Fall of 2021 Current Issue: Vehicle in service at Kia of Lincolnwood since January 9, 2026 Dear Kia Consumer Affairs and Legal Department, I am writing to formally document my severe dissatisfaction with the repeated engine failures in my Kia vehicle and the complete lack of communication and urgency from both Kia of Lincolnwood (6750 N Lincoln Ave, Lincolnwood, IL 60712) and Kia's consumer support channels. This has caused significant financial hardship, disruption to my family and work, and eroded any trust in the brand. I purchased this vehicle approximately 5 years ago through CarMax. Within that time, the engine has died or stalled three times: The first failure occurred about one year after purchase, stranding me at 11:00 p.m. in rural Wisconsin during winter with my three young children in the vehicle. The second incident happened in downtown Chicago (River North), just one hour before I needed to depart for a work event in Champaign, IL, requiring a tow and last-minute rental arrangements. The most recent failure occurred at approximately 4:30 a.m. after leaving my music studio, necessitating another tow and a $50 Uber ride home. Eleven months ago, Kia of Lincolnwood replaced the knock sensor under a one-year recall warranty. Despite this, the engine issues persisted. On January 9, 2026, I brought the vehicle to Kia of Lincolnwood for the third major engine-related failure. It has now been in the shop for nearly six weeks with no meaningful updates on diagnosis, repair timeline, or resolution. I have called the dealership at least ten times seeking callbacks from my assigned service advisor (Max) or any team member. In each instance, I was either hung up on, placed on hold for over an hour, or promised a return call that never came. We do our oil changes routinely. We had one done not too long ago. We were driving to the store and all of a sudden the oil light came on, but the engine light never came on. And then about 30 seconds later, we heard almost like a thump sound like we had hit something but we didn’t. We pulled into the grocery store parking lot about a minute after that, and there was oil leaking out of my car. We tried to put more oil in, but it just kept coming out. We have tried to see what’s going on. We can’t tell. We plan to get it towed and looked at. I don’t know if it will turn back on because I didn’t want to risk it and my engine locking up, but this seems to be an issue as I have read some of the other complaints.

While driving at low speed and turning, the vehicle experienced a sudden loss of power accompanied by engine knocking. The engine stalled and would no longer operate normally. The vehicle was inspected by a mechanic, who found metal fragments/shavings in the engine oil, indicating internal engine damage. The engine is now inoperable and has effectively failed. There were no warning signs prior to the failure other than the knocking noise immediately before the loss of power. This failure occurred suddenly and without driver input. The sudden engine failure caused a loss of propulsion while the vehicle was in use, creating a potential safety hazard for occupants and surrounding traffic. The vehicle required towing due to engine failure. Kia Consumer Assistance was contacted regarding the engine failure. I was informed that no recalls apply to this VIN and that the vehicle is out of warranty. Kia Consumer Assistance stated they would not inspect or document the engine failure unless I paid out of pocket.

The car engine started on fire while I was driving after all the recalls were fixed and new engine installed. The car was completely destroyed the whole engine compartment was completely burned. Kia says it was an oil leak but that’s not true the car oil change was done regularly and was serviced within 3 months of the engine fire. I also had this vehicle parked inside my garage for 5 years and not a single drop of oil in the garage floor. Kia is also refusing to send me a full report of their findings from the fire inspection. Kia adjuster is acting in bad faith by not providing the fire report. The car engine was replaced new due to an earlier recall and within 10,000 miles the new engine caught fire. They don’t want to be liable for this engine fire but cars don’t just burn without any reason. The refusal of KIA adjuster to release the findings in the fire inspection is very concerning to other people driving this vehicle in the public. Where engine fire can cause their deaths and their families deaths. This is a safety problem

The contact was stopped by another driver and was informed that the condensation coming out of the exhaust smelled like a bakery. We financed this 2014 Kia Sorento LX AWD from a used car dealer, and there has been nothing but problems with this vehicle. From the water pump, to insanely high oil consumption. I have verified that it is not leaking. Gaskets have been replaced, filters have been replaced, O2 sensors have been replaced, the water pump housing unit, impeller and pulley have been replaced, Spark plugs have been replaced and their boots, fuses have been replaced and renewed, even the brake light switch has been replaced. The coolant thermostat has been checked and it is functional, the MAP sensor is functional, the catalytic/exhaust manifold has been replaced, the in tank fuel pump/fuel sending unit has been replaced and the HPFP has been replaced and this vehicle still wants to consume oil like crazy and is flirting with deaths door step. It goes through fits of loss of power during acceleration in times when it really matters most, like trying to pass a vehicle. So most of the time I dont, because its not safe to try to pass vehicles and suddenly lose power and end up in a collision. I have checked all 6 recalls that have been opened and closed on my vehicle and part of me wonders if they were falsely closed. One of them indicates I should have had a partial, if not whole engine replacement at some point and I still have a VIN original engine in my vehicle. I have had this vehicle in my possession since August of 2025, and have done nothing but pour money into repairs on it, and i STILL feel like its going to leave me stranded on the side of the road. KIA needs to make good on their own warranty with as many issues as this year and model of vehicle that it has, and reinvestigate this vehicle. I believe the recalls on this vehicle were closed by a shady mechanic. Mind you, before it bought this vehicle, I had a mechanic look over it with an OBDII and no codes popped, none were stored and to this day, there still are none, but this engine is not behaving the way it should.

Severe paint delamination has occurred on the vehicle, causing the clear coat and base coat (Snow White Pearl color) to come off on the hood, pillars, roof, and rear sides of the vehicle. Not only does the peeling paint create an airborne/debris hazard, it also risks exposing the vehicle to premature rust/corrosion. This issue slowly began in 2019 and has only become much worse. From the information I have gathered online, this is a widespread issue affecting this particular model/year/color of Kia.

First off, we love the KIA Brand of vehicles. This is our fourth Kia. We also presently own a 2010 Optima with white paint and no peeling issues. Our Sorrento is currently showing (as of today) 133418 Miles. Sad to say that this is the only KIA we have ever owned with this very defective paint issue. Several months ago, I started to see several other 2014 Sorrento with the same peeling paint issues, so it wasn't just our vehicle. Your company is in the business of producing sophisticated and desirable vehicles designed by engineers who can cover all the bases in the manufacturing process. With the exception of this faulty paint issue, KIA has achieved this goal. I can only hope that KIA recognized this paint failure early and will go on to the next design phase. 1n my humble opinion, if KIA wants to keep growing the company brand they need to work like crazy to get to the next level in the paint process. Buyers want to have confidence that things as simple as a paint job will have a long life. Interesting when you look at very old vehicles for sale and the owners say this is the original paint. Thus, my question is how will KIA remedy this issue with both current and future model owners? l await your reply. I hope KIA will share a disclosure that is fundamental and not try to hide or mislead.

I have had nothing but issues with my Kia since I purchased it May 30th, 2023. It's continually stalling, completely looses power, sometimes won't operate at all. My Kia is very unsafe and completely unreliable. I had to have it towed to the dealership before my first payment was even due. My Kia has has to be taken to the dealership a total of 5 times and still nothing has been resolved, other than oil change, diagnostic testing, spark plugs replacement, "fuel system service", HECU fuse installed. As of today's date (June 19th, 2025) I still owe close to $12,000 on it. This is utterly ridiculous and needs to be resolved asap. It has been continual issues from May 30th, 2023 through current date (June 19th, 2025). In 15 months I have only been able to drive it 4,876 miles. That's how unreliable it is. I need help getting these issues resolved asap.

The high pressure fuel pipe that connects to the fuel pump outlet may have been damaged, misaligned or improperly torqued during the engine replacement procedure, possibly causing a fuel leak.

The Office of Defects Investigation (ODI) has received eight Hyundai Motor America (Hyundai) and eight Kia America, Inc. (Kia) Part 573 Recall Reports between 2016 and 2023. The combined 16 safety recalls all involve the antilock braking system (ABS) modules or Hydraulic Electronic Control Units (HECU) manufactured by the equipment supplier Mando. The Part 573 Recall Reports contain varying defect descriptions and differing remedy descriptions for the same or similar equipment supplied by Mando. Safety recalls included in this Audit Query (AQ) review include: Hyundai recalls 20V-520, 20V-543, 21V-161, 21V-160, 21V-303, 22V-056, 22V-810, and 23V-651. Kia recalls 16V-815, 20V-518, 20V-519, 21V-137, 21V-331, 22V-051, 22V-800, and 23V-652 The purpose of this AQ is to evaluate the timeliness and scoping of Hyundai and Kia’s defect decision making and adherence with reporting requirements; and understand the varying defect descriptions and remedies between these recalls.
The National Highway Traffic Safety Administration (NHTSA) received a letter dated July 13, 2022, petitioning the Agency to initiate a safety defect investigation into loss of motive power allegations attributed to oil drain pan assembly failures on certain Hyundai Motor America, Inc. and Kia America, Inc. vehicles spanning Model Years (MY) 2005-2021. The Petitioners cited examples of complaints indicating that the subject vehicles were experiencing rapid loss of engine oil due to oil drain plug back outs, resulting in loss of motive power and/or catastrophic engine damage. Additional complaints were provided which alleged that the oil drain pans lack sufficient structural integrity and are susceptible to cracking. The petition itself can be reviewed at NHTSA.gov under ODI number 11481745. On September 12, 2022, the Office of Defects Investigation (ODI) opened Defect Petition (DP22-003) to evaluate the Petitioners’ request. The Petitioners have provided additional complaints within four supplemental letters dated January 31, 2023, March 21, 2023, May 23, 2023, and August 4, 2023. ODI’s evaluation included the review and analysis of the complaints and supporting information submitted by the Petitioners, as well as additional complaints submitted directly to NHTSA which referenced either the oil drain plug or a crack in the oil pan. After reviewing the available data, ODI has not identified evidence that would support opening a defect investigation into the oil drain pan assemblies of the subject vehicles. Based on a review of the available information, a loss of motive power resulting from an oil drain plug back out has not occurred between the initial sale of a vehicle and the completion of its first oil change. If during an oil change service, a technician fails to remove the existing drain plug gasket before installing a new gasket, it is likely that a proper seal between the drain plug and the oil pan will not be made. An improper seal between the drain plug and oil pan could lead to the backing out on the drain plug, resulting in the sudden loss of oil while driving. Additionally, the provided examples of oil pan cracks were localized to the immediate vicinity of the oil drain plug and/or appeared to be the result of direct-contact with a tool during servicing. There is no information to support that a vehicle-based defect exists relating to the oil pan assembly, and instead the documented incidents are related to the failure to follow the proper maintenance procedures during oil change service. In October 2023, Hyundai published a Technical Service Bulletin (TSB) that provided detailed instructions for oil change service on its gasoline powered vehicles, specifically highlighting the need to remove and replace the existing drain plug gasket prior to reinstalling the drain plug. After a thorough review of the material submitted by the petitioner, the information already in NHTSA's possession, and the potential risks to motor vehicle safety implicated by the petitioners' allegations, NHTSA does not believe that a formal investigation is warranted. Therefore, the petition is denied. A Federal Register Notice (FRN) further detailing NHTSA’s reasons for denial of the petition will be published. On March 29, 2019, the Office of Defects Investigation (ODI) opened two Preliminary Evaluations (PE19-003 on Hyundai and PE19-004 on Kia) to broadly investigate incidents of non-crash fires (regardless of origin or operational status of the vehicle) on various model year Hyundai and Kia vehicles. During the PE investigations, Hyundai and Kia issued several recalls to address vehicle fires, including those due to engine failures involving various engine types. The remedies for the engine failure recalls typically involve engine inspection (to detect existing damage), and if necessary, engine replacement. Additionally, both manufacturers have been installing an engine control software modification known as Knock Sensor Detection Software (KSDS) which is intended to detect impending engine failure, alert the driver, and limit engine power (to lessen likelihood of engine failure).KSDS is being installed under recalls and non-safety field actions, and both companies have extended limited engine warranties (see recall files). On December 22, 2021, ODI upgraded PE19-003 and PE19-004 to this Engineering Analysis (EA21-003, covering both Hyundai and Kia) to evaluate the scope of the prior recalls related to engine failures/fires and the efficacy of the recall remedies for the recalls, as well as the long-term viability of related programs and non-safety field actions being conducted by Hyundai and Kia. The former issue involved approximately 550,000 MY 2013 Hyundai Elantra, MY 2011 Kia Sorento, and MY 2012-2015 Kia Rio. The latter issue involved approximately 2.5 million recalled vehicles, which have been identified as displaying potential remedy concerns: Hyundai recalls 15V-568, 17V-226, 20V-746, and 21V-727; and Kia recalls 17V-224, 19V-120, 20V-750, and 21V-844. Regarding the recall scope issue, among all of the scope vehicles identified at EA opening, ODI found only the MY 2011 Kia Sorento vehicles equipped with both the Theta II 2.4L 4-cylinder Multi-Point Injection (MPI) and the Lambda II 3.5L 6-cylinder MPI engines experienced relatively high rates of reported fires. In December 2023, Kia issued recall 23V-877 that will cover about 80,000 MY 2011 Kia Sorento vehicles equipped with the Theta II 2.4L MPI engines. The remedy will involve an inspection, and if necessary, a replacement of the engine, as well as the installation of KSDS. It should be noted that in 2021 these vehicles were included in a KSDS product improvement campaign with warranty extension. For the MY 2011 Sorento vehicles equipped with the Lambda II 3.5L engines, ODI believes that future engine failures/fires involving these vehicles will likely be due to a lax in adhering to the proper or scheduled engine maintenance (regular engine oil changes), rather than a design or manufacturing engine issue. Regarding the issue of the efficacy of the recall remedies, ODI found the majority of the recalled Hyundai and Kia vehicles, by model, experienced lower reported fire rates after the remedies were applied. Furthermore, ODI found that for most vehicles that did not receive the recall remedies, by model, experienced relatively high fire rates. To address this problem, Hyundai informed ODI in December 2023, that it will renotify all of its owners covered by the Hyundai recalls of engine failures/fires every 8 months for the next 3 years. In December 2023, Kia stated that it will renotify the majority of its owners every 8 months for the next 3 years.Several previously recalled Kia models are excluded from the renotification due to their lower reported rates of engine fires. Overall, the renotification actions will help to increase the recall completion rates, thus reduce the frequency of engine fires in the future. In view of the recall action being taken by Kia and renotification actions being taken by both Kia and Hyundai, ODI is closing this Engineering Analysis. Also, both companies have been released from the 2020-iniated Consent Orders (Kia since November 2022 and Hyundai since November 2023). The agency reserves the right to take additional action if warranted by future circumstances. The Office of Defects Investigation (ODI) of the National Highway Traffic Safety Administration (NHTSA) received a petition letter dated October 10, 2021, requesting an investigation of possible defects in the electronic throttle control (ETC) system on certain Kia vehicles resulting in the opening of DP21-003. Accordingly, Model Year (MY) 2005-2016 Kia Optima/K5, MY 2006-2015 Kia Sorento, MY 2007-2016 Hyundai Elantra, MY 2007-2016 Hyundai Santa Fe, MY 2006-2015 Hyundai Sonatas are all part of the subject population. The petition was originally filed as a Vehicle Owner Questionnaire that can be reviewed at NHTSA.gov under reference (ODI) number 11439675.On November 12, 2021, ODI opened Defect Petition DP21-003 to evaluate the petitioner?s request. ODI performed trend analyses of the VOQs related to vehicle speed control issues for all the subject vehicles and found that none of the 52 Model/Model Year Hyundai/Kia vehicles demonstrated any actionable trend that warranted an investigation.Petitioners submitted 1119 VOQs and non-VOQ cases in which sudden uncommanded acceleration (SUA) or loss of motive power (LOMP) incidents were alleged.For the 1119 reports, 220 were incidents involving crashes, from which 69 subject Hyundai-Kia vehicles were inspected by Hyundai/Kia dealer technicians, Hyundai/Kia engineers, and/or third-party representatives.ODI found the inspections identified no vehicle defects related to the ETC system.Of the 220 crash-involved reports, 13 Event Data Recorder (EDR) records were downloaded successfully and 11 of those indicated driver error: (i.e.) pedal misapplication.A condition where the accelerator pedal is mistakenly applied instead of the brake pedal when the driver wants to stop the vehicle.In addition, ODI reviewed a scientific journal paper published in Forensic Science International in 2016 by Mr. Park et al ., as well as related test videos. ODI does not believe there is any evidence of uncontrollable SUA occurrences in any of the tests reviewed. NHTSA's Office of Vehicle Safety Compliance (OVSC) reviewed the allegations regarding the potential noncompliance with Federal Motor Vehicle Safety Standard No. 124.Based on the information provided, the Agency concludes there is insufficient information for us to determine if a possible non-compliance exists.Finally, both Hyundai and Kia informed ODI that all their vehicles manufactured after 2012 were equipped with an ETC management system, in which the engine speed will go to idle when the system sees signals from both the brake pedal and accelerator pedal at the same time; this is commonly known as the brake-throttle override system.After thoroughly assessing the material submitted by the petitioner, information already in NHTSA's possession, information submitted by Hyundai and Kia in response to an Information Request letter, and the potential risks to safety implicated by the petitioner's allegation, NHTSA does not believe that a formal investigation is warranted. After full consideration of appropriate factors, the petition is denied. A Federal Register Notice (FRN) further detailing NHTSA?s reasons for denial of the petition will be published.
During this Preliminary Evaluation (PE), the Office of Defects Investigation (ODI) assessed the scope, frequency and potential safety-related consequences of non-crash vehicle fires caused by both engine failures and failures of other vehicle systems/components in model year (MY) 2011-2014 Kia Optima, MY 2011-2014 Kia Sorento and MY 2010-2015 Kia Soul vehicles equipped with Theta II, Gamma, Nu and Lambda II engines (approximately 1.7 million vehicles). In a letter dated June 11, 2018, the Center for Auto Safety (CAS) petitioned the National Highway Traffic Safety Administration (NHTSA) to initiate a safety defect investigation into non-collision related fires on model year (MY) 2011-2014 Kia Optima and Sorento, and Hyundai Sonata and Santa Fe vehicles. In a letter dated July 24, 2018, CAS requested that MY 2010-2015 Kia Soul vehicles be added to the petition. CAS stated that there is a higher number of complaints to NHTSA regarding non-crash fires on these vehicles compared to other similar vehicles. The Office of Defects Investigation (ODI) had already opened Recall Queries (RQ17-003 and RQ17-004) on all Kia and Hyundai vehicles equipped with Theta II engines for engine failures that may cause stalling and fires.The queries cover most of the petition subject Optima, Sorento, Sonata, and Santa Fe vehicles but not any of the subject Soul vehicles.On August 21, 2018, ODI opened a Defect Petition (DP18-003) to evaluate whether to grant or deny the CAS petition. ODI sent Information Request letters to Kia and Hyundai (September and October 2018) requesting information on all engine and non-engine related fires in the petition vehicles.ODI performed extensive analysis on the information obtained from Kia and Hyundai. During the DP18-003 analysis, Kia and Hyundai each initiated three additional safety recalls related to engine compartment fires on certain petitioned and non-petitioned vehicles (nearly 740,000 total vehicles: Recalls 18V-907, 18V-934, 19V-101, 19V-063, 19V-120, and 19V-204). Based on ODI?s review of the applicable materials, including responses to Information Requests sent to multiple manufacturers, Vehicle Owner Questionnaires (VOQ), and Early Warning Data, NHTSA decided to grant the petition.The CAS petition was granted on March 29, 2019. Preliminary Evaluations (PE19-003 on Hyundai and PE19-004 on Kia) have been opened to assess the scope, frequency, and potential safety-related consequences of alleged defects relating to non-collision vehicle fires in the 2011-2014 Kia Optima and Sorento, 2011-2014 Hyundai Sonata and Santa Fe, and 2010-2015 Kia Soul.Attached is a list of the reference numbers for the 404 VOQs cited above.
NHTSA opened Recall Query (RQ) 17-003 to investigate the timeliness and scope of Kia?s Theta II GDI engine recall (Recall No. 17V-224), and Kia?s compliance with reporting requirements. On November 23, 2020, the Agency entered into a Consent Order with Kia to administratively resolve NHTSA?s assertions of violations of law in connection with RQ17-003. NHTSA?s assertions included that Kia may be liable for civil penalties on multiple grounds, including that Recall No. 17V-224 was untimely and Kia?s recall report contained certain inaccuracies.Under the Consent Order, Kia agreed to a total civil penalty of $70,000,000. The total civil penalty included a payment of $27,000,000 as a Non-Deferred Amount.Kia also agreed to a sum of $27,000,000 as an Abeyance Amount to be deferred and held in abeyance pending its satisfactory completion, as reasonably determined by NHTSA, of the requirements of the Consent Order.Kia also agreed to a $16,000,000 Performance Obligation Amount to be expended by Kia to fulfill specified Safety Data Analytics Infrastructure obligations. The Consent Order also includes other terms designed to enhance Kia?s safety practices, and requires Kia to retain a Third-Party Auditor who directly reports to NHTSA.Other than RQ17-003, the Consent Order is not intended to affect any other current or future investigation of NHTSA which may involve vehicles equipped with Theta II GDI engines. In particular, Engineering Analysis (EA) 21-003 (which is upgraded from Preliminary Evaluation (PE) 19-004) continues NHTSA?s evaluation of certain performance and design issues relating to the Theta II and other engines.Nothing in the Consent Order discharges Kia from any obligation to comply with the Safety Act or regulations thereunder, including the obligation to carry out recalls in accordance with the law, and to initiate a recall upon any future determination by Kia, or upon any finally adjudicated order from NHTSA, that vehicles equipped with Theta II GDI engines contain a defect related to motor vehicle safety or do not comply with an applicable FMVSS.This RQ is closed. Closure of this RQ has no bearing on the terms of the Consent Order, including Kia's ongoing performance obligations, and does not represent a determination by the agency as to Kia's performance under the Consent Order to date.
In a letter dated August 9, 2013, Hyundai-Kia America Technical Center, Inc. (Hyundai-Kia) submitted two Defect Information Reports (DIR) to NHTSA identifying a safety defect related to fracture of the right front axle shaft in MY 2013 front wheel drive Hyundai Santa Fe Sport vehicles built from July 13, 2012 through March 12, 2013 and MY 2014 front wheel drive Kia Sorento vehicles built from January 7 through March 12, 2013 (Recall Nos. 13V-355 and 13V-356).According to Hyundai-Kia, the right front axle driveshaft may develop a crack in the area of the stub at the wheel end of the shaft due to problems with the stub supplier's forging process for axles installed in vehicles built prior to March 12, 2013.When moving from a stop, the crack can lead to a separation of the shaft, causing a loud noise and loss of motive power.In addition, should the driver fail to engage the parking brake on an inclined surface, the vehicle may roll.In either case, a crash could result.ODI's review of consumer complaints and data submitted by Hyundai-Kia, identified 21 complaints alleging right-front axle shaft failure and 60 warranty claims related to right front axle replacements.All of the vehicles identified in the complaints and warranty claims were manufactured during the vehicle builds periods identified in the DIR.The Preliminary Evaluation is closed.The ODI report cited above can be reviewed at www-odi.nhtsa.dot.gov/owners/SearchNHTSAID under the following identification (ODI) numbers: 10524563, 10524274, 10508727, and 10505768.
