While driving under normal conditions, the panoramic sunroof glass suddenly shattered without warning. There was no impact from road debris, no prior cracking, and no abnormal use of the sunroof. The failure occurred spontaneously and created a safety hazard due to falling glass and the risk of driver distraction or injury. This vehicle is equipped with the factory panoramic roof that has been the subject of a prior class action lawsuit and Hyundai Technical Service Bulletin 19-BD-007H (Panoramic Roof Moving Glass Warranty Extension, code TXXE). The failure I experienced is consistent with the known defect described in that settlement and TSB. Hyundai extended coverage for this defect to 10 years or 120,000 miles; however, Hyundai has denied assistance because the time limit has expired, even though the mileage remains within the coverage threshold. Given the known defect and safety implications, this failure should be addressed regardless of warranty expiration. This issue presents a safety concern due to sudden glass shattering while driving and should be investigated further.

My brakes are GRINDING SERIOUSLY and PROHIBITING me to fully stop at times. I’ve had several near misses… I want them fixed now!! My car is no longer safe!!! Still doing it today @ 12:18pm with mileage of 130,605… please help!

On January 26, 2024, at AutoNation, I was requested to bring my 2010 Hyundai Tucson in to replace a part involving my ‘brakes.’ I’m the original owner, since 2021 my brakes would grind at least twice weekly and I was afraid I wouldn’t be able to stop! Then, the AntiLock Brake System lights would just pop up out of nowhere and come on, then my brakes would work. So, I was told I needed a new switch. AutoNation never let me explain any of this, they cut me off anytime I tried to explain it. So, last January 2024, the switch was fixed. I’d prefer NOT to go back there again!! It hasn’t been inspected by anyone. NHTSA may inspect it as soon as you would like. Except now, my ABS lights are basically stuck on. This started back again June 2024. No grinding of my brakes now, I just want them fixed properly.

UNKNOWN. Since I purchase this vehicle in 2010, the backup camera does not always work. I took it in to the dealership and they stated that in order to diagnose it, it must happen while I am there. At this time, the backup camera only works sometimes and it is not safe to back up. Is there a manufacturer recall?

Every morning the car has to have a jump! We bought a battery! That didn't help! We took it to the shop, they couldn't figure it out but said it was something to do with the electrical but didn't know what, so we started digging on our own and you have to take the fuse out to the radio for the car to start! So after spending ALL that money that's what it is, we can't listen to music to start our every morning but now it is getting worse, something else is draining the battery! And no one knows what!

Yesterday, my wife car, suddenly started to sharply to the right, when her hold on steering wheel relaxed. I tested it. It is not an alignment problem. It is a sudden and obvious taking over of the steering by the car. I took it to my mechanic. He told me that he and none of his certified mechanics have ever seen this problem, and did not know what was wrong and I should contact Hyundai as perhaps there was a recall or service bulletin on this condition. I did that, but was told that I would have to bring it there to be diagnosed. My concern is not so much for my car. I don't know if I want to spend dealership type money to fix the car. My concern is the safety of others. My wife was traveling about 20 mph when this happened, and was able to avid hitting another car. If it happened when she was traveling 60 mph on a four lane highway, it would have been a major disaster. I felt that I needed to bring the problem to your attention, to possibly protect others. THE CONSUMER STATED THE DEALER ADVISED THE PART NECESSARY TO COMPLETE THE REPAIR WAS NO LONGER IN PRODUCTION; THEREFORE, THE VEHICLE COULD NOT BE REPAIRED. MANUFACTURER WAS CONTACTED AND DECLINED ANY ASSISTANCE.

SINCE I GOT THIS VEHICLE THE GEAR SHIFT GETS STUCK. I HAVE GONE TO THE DEALERSHIP TO GET THE PROBLEM FIXED. THE PROBLEM HAS BEEN THE BACKLIGHT SWITCH. IT IS A BIG HASSLE TRYING TO GET THIS PROBLEM FIXED WITH THE DEALERSHIP. THE BACKLIGHT SWITCH LAST TWO TO THREE YEARS. I GOT THE RECALL LETTER ABOUT THE BACKLIGHT SWITCH IN 2012, BUT WHY MY VIN NUMBER IS NOT LISTED? THE DEALERSHIP HAS BEEN CHARGING ME EVERY SINGLE TIME I HAVE BEEN THERE FOR THIS CONSTANT PROBLEM. I ALMOST GOT KILL BY THE TRAIN BECAUSE OF THIS BACKLIGHT SWITCH PROBLEM. I GOT STUCK A FEET AWAY FROM THE RAIL TRACKS TWO WEEKS AGO, THERE WAS A CAR AT FRONT OF ME AND I COULDN'T MOVE THE GEAR SHIFT TO REVERSE. THE CAR DECIDED TO MOVE AT THE LAST MINUTE AND I COULDN'T DO ANYTHING. THE CONTENTION BAR WAS OVER MY WINDSHIELD SO I COULDN'T MOVE FORWARD AND I COULDN'T MOVE BACKWARDS BECAUSE THE GEAR SHIFT WASN'T MOVING. I HAVE BEEN IN THE DEALERSHIP FOR FIVE TIMES AND THE LAST TWO TIMES, THEY HAVE KEPT MY CAR THERE, BUT THEY HAVEN'T EVEN TOUCHED IT. THEY HAVEN'T TOLD ME THE REASON WHY, BUT I JUST FOUND IT OUT. IT IS BECAUSE MY VIN NUMBER IS NOT LISTED. THIS IS A VERY DANGEROUS PROBLEM. DRIVING A CAR WITH THIS PROBLEM ONCE YOU APPLY THE BRAKES THE GEAR SHIFT WON'T WORK. NEITHER IN CASE YOU HAVE TO PARK OR MAKE A TURN. PICKING UP MY DAUGHTER FROM SCHOOL IS A BIG PROBLEM BECAUSE ONCE I PARK, THE GEAR SHIFT DOESN'T MOVE DOWN, SO I HAVE TO TURN IT OFF UP TO THREE TIMES AND WAIT EACH TIME TWO TO THREE MINUTES UNTIL THE ENGINE RESETS ITSELF. DRIVERS BEHIND ME GET SO FRUSTRATED. WOULD YOU PLEASE HELP ME TO LIST MY VIN NUMBER? I AM VERY CONCERNED DRIVING THIS CAR WITH MY FAMILY.

I FIRST NOTICED WHITE SMOKE COMING FROM THE BACK OF MY SUV. I PULLED INTO A STORE PARKING LOT AND TRIED TO PARK. MY MAIN BRAKES FAILED. I THEN TRIED USING MY EMERGENCY BRAKE. IT TOO FAILED. WHITE SMOKE STARTED COMING THROUGH THE VENTS SO I TURNED THEM AWAY FROM ME AND TRIED SHIFTING TO PARK WITH NO SUCCESS. I THEN PRESSED THE MAIN BRAKE AGAIN AND WAS ABLE TO SHIFT TO PARK. THEN SOMEONE IN THE PARKING LOT YELLED, "YOUR CAR'S ON FIRE! GET OUT!" I GRABBED MY KEYS, CELL PHONE AND WORK BADGE AND AS I WAS GETTING OUT, BLACK SMOKE BEGAN FILLING THE CABIN. STORE EMPLOYEES TRIED TO PUT OUT THE FIRE WITH FIRE EXTINGUISHERS WITH NO SUCCESS. WITHIN 10 MINUTES THE FRONT HALF OF THE SUV WAS ENGULFED IN FLAMES! I HAVE NO CLUE WHAT COULD HAVE CAUSED THE BRAKES TO FAIL NOR THE REASON FOR THE ENGINE TO CATCH FIRE! I HAVE VIDEO AND PHOTOS FOR VIEWING.

WHEN TRAVELING AT ABOUT 35-40 MPH, THE VEHICLE SOMETIMES DOES NOT ENGAGE WHEN TRYING TO AUTOMATICALLY SHIFT TO THE NEXT GEAR. THIS CAUSES THE DRIVER TO LOSE ALL ACCELERATION AND ESSENTIALLY PUTS THE VEHICLE INTO A COAST. TAPPING ON THE ACCELERATOR DOES NOTHING TO ENGAGE THE TRANSMISSION AGAIN. HOWEVER, AFTER A FEW SECONDS OR MORE, THE TRANSMISSION WILL FINALLY ENGAGE. IF YOU HAPPEN TO HAVE THE ACCELERATOR PRESSED THIS WILL LURCH THE VEHICLE FORWARD. IF YOU HAPPEN TO BE BEHIND ANOTHER VEHICLE THIS COULD POTENTIAL CAUSE AN ACCIDENT BY RAMMING THE VEHICLE IN FRONT OF YOU. THERE HAVE BEEN A COUPLE OF 'CLOSE CALLS'. I HAVE VIDEOS OF THE ENGINE REVVING THAT I CAN SUPPLY, BUT THE FILE SIZES ARE TOO LARGE TO UPLOAD. THIS HAS BEEN OCCURRING SINCE I PURCHASED THE VEHICLE NEW. THEY REPLACED THE TRANSMISSION AT 5000 MILES FOR A SIMILAR SITUATION. THE PROBLEM OCCURRENCE DIMINISHED, BUT OVER THE YEARS THE PROBLEM HAS BEEN HAPPENING MORE FREQUENTLY. I HAVE ALWAYS REPORTED THIS TO THE DEALER WHEN TAKING IT IN FOR SERVICE. THE DEALER HAS BEEN UNABLE TO REPLICATE THE SITUATION OR OFFER ANY SOLUTION. THEY HAVE BEEN SUPPLIED WITH THE VIDEOS. THE EXACT CAUSE OF THIS IS CURRENTLY UNKNOWN.

ON THREE SEPARATE OCCASIONS THIS VEHICLE EXPERIENCED UNINTENTIONAL ACCELERATION WHILE EITHER BRAKING OR SLOWLY ATTEMPTING TO PARK. DURING EACH INCIDENT THE AUTO ACCELERATED AT HIGH SPEED WHILE MY FOOT WAS ON THE BRAKE AND I WAS UNABLE TO STOP THE AUTO FROM PROCEEDING FORWARD EVEN WITH BOTH FEET HEAVILY APPLIED TO THE BRAKES. EACH TIME I WAS LUCKILY ABLE TO MANEUVER TO AVOID HITTING ANY PEDESTRIANS IN MY PATH AND FORTUNATELY THERE WERE NO HUMAN INJURIES DURING ANY OF THESE OCCASIONS. HOWEVER, TWO OF THE INCIDENTS DID RESULT IN A COLLISION. THE FIRST WAS A MINOR REAR END CRASH RESULTING FROM THE INABILITY TO STOP THE AUTO WHEN IT UNINTENTIONALLY ACCELERATED WHILE BRAKING FOR A RED LIGHT. THE LAST INCIDENT RESULTED IN EXPENSIVE AUTO DAMAGE WHEN THE AUTO UNINTENTIONALLY ACCELERATED WHILE SLOWLY PULLING INTO A PARKING SPOT ALONG THE STREET AND CAUSING THE AUTO TO JUMP THE CURB. TO AVOID HITTING PEDESTRIANS WALKING ON THE SIDEWALK OR CRASHING INTO A STOREFRONT, I WAS FORCED TO COLLIDE INTO A TELEPHONE POLE TO STOP THE AUTO RESULTING IN THOUSANDS OF DOLLARS OF FRONT END DAMAGE. *TR

MY PROBLEM WITH THIS TUCSON IS IN REGARDS OF "SUDDEN UNINTENDED ACCELERATION". IT SPORADICALLY, ON AN ALMOST DAILY BASIS WE EXPERIENCE "SUA" FOLLOWED BY IMMEDIATELY LOSES POWER AND ACCELERATION EVERY TIME IT'S DRIVEN. EX: DRIVING ON THE FREEWAY DOING 70MPH, IT WILL LUNGE AND THE TACHOMETER WILL RACE AND SUDDENLY LOSES POWER DOWN TO 35MPH. THEN HAS A LAG ACCELERATING AFTERWARDS. THIS IS CONSISTENT THROUGH OUT THE DAY SINCE I COMMUTE A LOT. OTHER ISSUES, WHEN ENGINE ON IDLE IT FEELS LIKE IT'S ABOUT TO STALL. WE HAVE TAKEN THIS TO THE DEALERSHIP 3 TIMES AND FROM THEIR DIAGNOSIS, THEY DON'T SEE THE PROBLEM. THERE IS DEFINITELY A MALFUNCTION IN THE TRANSMISSION AND DOING RESEARCH I'VE FOUND THESE ISSUES WITH NUMEROUS TUCSON OWNERS. WE ARE CONCERNED WITH OUR SAFETY AS WE NOW HAVE HAD A COUPLE OF CLOSE CALLS ON THE FREEWAY. WE BOUGHT THIS VEHICLE FOR SAFETY AND NOW ARE STARTING TO QUESTION OUR SAFETY DUE TO THIS ISSUE. *TR

LUCKILY I WAS IN A PARKING LOT BECAUSE IF IT HAD STALLED ON THE HIGHWAY I COULD OF CREATED A ACCIDENT. THE CAR JUST FROZE. *TR

OVER THE LAST WEEK, MY CAR HAS GOTTEN STUCK IN PARK ON 3 OCCASIONS. THIS IS A PROBLEM WITH THE BRAKE SWITCH. APPARENTLY, HYUNDAI AND KIA HAVE RECALLED 1.9M CARS WITH THIS PROBLEM BUT THE HYUNDAI TUCSON IS ONLY RECALLED UP TO YEAR 2009. MINE IS A 2010 AND NOT INCLUDED IN THE RECALL. HOWEVER, THIS IS A SERIOUS PROBLEM, AS THE CAR MIGHT NOT COME OUT OF CRUISE IF THIS HAPPENS WHILE DRIVING. ALL IT HAS CAUSED ME SO FAR IS FRUSTRATION AND PANIC. *TR

SEE OID 10434752. SAME ISSUE. HAD PROBLEMS GETTING VEHICLE INTO PARK. THAT ISSUE APPEARS RESOLVED. HOWEVER, ONE DAY THE STEREO WAS STAYING ON FOR A FEW SECONDS AFTER THE CAR WAS TURNED OFF. TWO DAYS LATER, THERE WAS NO AUDIO FROM THE STEREO, GPS OR BLUETOOTH. THEY ALL APPEAR TO BE WORKING (RADIO CHANGES STATIONS/VOLUME, GPS OPERATES NORMALLY AND I CAN MAKE CALLS USING BLUETOOTH), THERE IS JUST NO AUDIO OUTPUT. WHEN I TOOK THE VEHICLE TO THE DEALER, THEY DID NOT DO ANY DIAGNOSTICS ASIDE FROM TURNING ON THE STEREO BEFORE TELLING ME THE STEREO NEEDED TO BE REPLACED AND THAT IS NOT UNDER WARRANTY, FACTORY OR EXTENDED. THERE HAVE BEEN SOME OTHER UNUSUAL ELECTRICAL ISSUES LIKE THE TURN SIGNAL REMAINING ON AFTER THE LEVER WENT BACK TO THE OFF POSITION AND THERE BEING A DELAY OR COMPLETE FAILURE OF THE AUTOMATIC HEADLIGHTS. *TR

FOR AWHILE NOTICED OCCASIONAL BUT UNUSUAL INCREASE IN RPM'S. DIDN'T THINK MUCH OF IT UNTIL INCIDENT ON HIGHWAY WHEN CAR MADE A LOUD NOISE, AND LURCHED FORWARD AS IF WE HIT SOMETHING. IMMEDIATELY PULLED OFF ROAD, AND DIDN'T NOTICE ANY DAMAGE. TOOK CAR TO DEALER WHEN THEY "RESET" SOMETHING AND SAID THE CAR WAS GOOD. PROBLEMS WITH RPM'S HAVE CONTINUED, AND TOOK CAR TO DEALERSHIP 4 MORE TIMES WITH IDENTICAL FAULTS. AT ONE POINT THEY REPLACED A SOLENOID, WHICH APPEARED TO FIX IT FOR ABOUT 2 WEEKS. WERE TOLD THEY CAN NOT DUPLICATE THE FAULTS, CAR IS FINE, AND THERE IS NOTHING THEY CAN DO. THEY SAID THE TRANSMISSION LEARNS YOUR PATTERNS AND SOMETHING MIGHT HAVE GOTTEN CONFUSED. I'M EXTREMELY FRUSTRATED WITH THIS. IT'S CLEARLY A SAFETY HAZARD, THAT WILL ONLY CONTINUE TO GET WORSE. IT'S MY WIFE'S PRIMARY VEHICLE AND I FEAR FOR HER SAFETY. AFTER HAVING A SERVICE ON MY 2010 HYUNDAI TUCSON, 2 DAYS LATER THE ESC INDICATOR LIGHT CAME ON, AND THE DBC INDICATOR LIGHT CAME ON, AND THE SHIFTER WAS HARD TO PUT INTO GEAR. TOOK IT IN AND THEY CHANGED THE SHIFTER. ABOUT 2 WEEKS LATER THE SAME TWO LIGHTS CAME ON AGAIN, ONLY THIS TIME WHEN YOU PRESSED ON THE GAS THE RPM WOULD SHOOT UP BUT THE CAR WOULDN'T MOVE, AND THE BRAKES WERE LOCKED. THE CAR WAS TOWED AND THE MAP SENSOR WAS CHANGED. WHEN I WAS TOLD THE CAR WAS FIXED I CAME IN TO TEST DRIVE THE CAR AND THE CHECK ENGINE LIGHT WAS ON. I DID NOT TAKE THE CAR. THE NEXT DAY THE CAR WAS GIVEN BACK TO ME AND THE LIGHT WAS OFF. 2 WEEKS LATER THE SAME PROBLEM HAPPENED AGAIN. I WAS TOLD THAT THE BRAKES NEEDED TO BE BLED, AFTER A FEW DAYS THE CAR WAS GIVEN BACK TO ME. 4 WEEKS LATER THE SAME PROBLEM OCCURRED AGAIN, AND THE CAR WAS TOWED, ANOTHER PART WAS CHANGED AGAIN. I KNOW THAT THE SHOP I AM WORKING WITH IS TRYING THEIR BEST TO FIX THE PROBLEM, BUT THE CAR IS SCARY TO DRIVE. AT ANY TIME THE ESC AND DBC LIGHT WILL COME ON, AND THE BRAKES WILL LOCK, AND WHEN YOU PRESS THE GAS THE RMP WILL SHOOT UP AND THE CAR WON'T MOVE. TWICE NOW THIS HAS HAPPENED TO BE ON A MAIN HIGHWAY AND I DO GOOD TO PULL OVER BEFORE SOMEONE HITS ME. *TR

ISSUE: THE INTERIOR PLASTIC COVER ATTACHED TO THE SHIFTER LOCATED NEXT TO THE CUP HOLDERS WILL CRUMPLE-UP AFTER SOME SODA IS SPILLED ON IT - CREATING A SAFETY ISSUE BECAUSE THE CRUMPLED PLASTIC WILL MAKE IT DIFFICULT OR PROHIBIT THE SHIFTER TO BE PLACED IN PARK OR DRIVE. IF WEAK INDIVIDUAL ENCOUNTERS THIS CONDITION ON A SLOPED SURFACE THE CAR MAY ROLL UP OR DOWN THE SLOPE BECAUSE WHILE IT MAY BE DIFFICULT TO PLACE IT IN PARK OR DRIVE - THE CAR CAN BE PLACED IN NEUTRAL. THIS ALL STARTED WHEN ON A APRIL 1, 2011, FRIDAY TRIP FROM CEDAR PARK, TO CORPUS CHRISTI, TX. I STOPPED AND PICKED UP A BURGER AND COKE. I PLACED THE COKE IN THE CUP HOLDER AND CONTINUED ON MY TRIP- SOME OF THE COKE SPILLED BECAUSE THE LID CAME LOOSE. I SECURED THE LID ON THE CUP AND WIPED DOWN THE AREA WHERE THE COKE HAD SPILLED. ON APRIL 2, 2011 SATURDAY, I NOTICED THAT THE IT WAS HARD TO SHIFT BUT DID NOT THINK MUCH OF IT . I RETURNED TO CEDAR PARK ON APRIL 3, SUNDAY. BY APRIL 4, MONDAY, THE SHIFTER PLASTIC WAS A CRUMPLED MESS AND I HAD TO USE A BOX CUTTER TO CUT THROUGH THE PLASTIC SO I COULD PLACE THE CAR IN PARK OR DRIVE. I TOOK MY CAR TO THE HYUNDAI DEALERSHIP WHERE I BOUGHT IT, AND DROPPED IT OFF TO BE SERVICED. SO I WAS SURPRISED AND DISAPPOINTED WHEN THE SERVICE ADVISOR, CALLED AND SAID THAT THE SERVICE MANAGER HAD DIRECTED SHE TELL US THAT BECAUSE SOME LIQUID HAD BEEN SPILLED ON THE PLASTIC CAUSING IT TO BECOME STICKY - THAT THE REPAIR WAS NOT COVERED BY WARRANTY AND THAT WE WOULD HAVE TO PAY $250.00. THERE IS NO EXCUSE FOR ANY AMOUNT OF SPILLED SODA TO CAUSE THE PLASTIC SHIFT COVER TO CRUMPLE AND IMPEDE PROPER OPERATION OF THE GEAR SHIFTER. THIS IS A DESIGN AND ENGINEERING FLAW WHICH COULD POSSIBLY RESULT IN INJURY OR DEATH. A RECALL TO CORRECT AND REPAIR THIS PROBLEM NEEDS TO BE INITIATED. *TR

Hyundai Motor Company (Hyundai) is recalling certain model year 2006-2009 Accent, model year 2007-2011 Azera, Sonata and Sante Fe,2006-2011 Tucson, 2009-2011 Elantra Touring, 2007-2010 Elantra, 2008-2011 Veracruz, 2009-2011 Genesis, 2010-2011 Genesis Coupe, 2007-2008 Entourage, and 2006-2008 Tiburon vehicles. Originally, in April 2013, Hyundai recalled 1,059,824 model year 2007-2009 Accent and Tucson, model year 2007-2010 Elantra, model year 2007-2011 Santa Fe, model year 2008-2009 Veracruz, model year 2010-2011 Genesis Coupe, and model year 2011 Sonata vehicles. In September 2013, Hyundai informed the agency that it was adding more vehicles to this campaign, representing an additional 652,512 units. The total number of vehicles being recalled is now 1,712,336. In the affected vehicles, the stop lamp switch may malfunction. A malfunctioning stop lamp switch may cause the brake lights to not illuminate when the brake pedal is depressed or may cause an inability to deactivate the cruise control by depressing the brake pedal. Additionally, a malfunctioning stop lamp switch may also result in intermittent operation of the push-button start feature, affect the operation of the brake transmission shift interlock feature, preventing the shifter from being moved out of the PARK position and cause the Electronic Stability Control (ESC) malfunction light to illuminate.

Risk: Failure to illuminate the stop lamps during braking or inability to disengage the cruise control could increase the risk of a crash. Additionally, when the ignition is in the 'ON' position, the transmission shifter may be able to be moved out of Park without first applying the brake. This may lead to unintentional movement of the car which may increase the risk of a crash.

Remedy: Hyundai will notify owners, and dealers will replace the stop lamp switch, free of charge. The safety recall began on April 22, 2013. Owners may contact Hyundai at 1-800-633-5151. Hyundai's recall campaign number is 110.

HYUNDAI IS RECALLING CERTAIN MODEL YEAR 2010 TUCSON VEHICLES. PROPERLY SEATED ADULT RIGHT FRONT SEAT PASSENGERS WEIGHING OVER APPROXIMATELY 240 POUNDS CAUSE THE PASSIVE OCCUPANT DETECTION SYSTEM (PODS) MODULE PROGRAM TO ILLUMINATE THE "AIR BAG" WARNING LAMP.

Risk: IF "AIR BAG" WARNING LAMP IS ILLUMINATED, THE PASSENGER AIR BAG WILL DEPLOY IF A CRASH OF SUFFICIENT FORCE TO REQUIRE FRONT AIR BAG DEPLOYMENT IS EXPERIENCED, AND WILL NOT BE DEACTIVATED IF A CHILD IS SEATED IN THE RIGHT FRONT SEATING POSITION, WHICH MAY INCREASE THE RISK OF INJURY TO A CHILD FRONT PASSENGER.

Remedy: DEALERS WILL REPROGRAM THE PODS MODULE FREE OF CHARGE. HYUNDAI ANTICIPATES OWNERS NOTIFICATION BEGAN BY TELEPHONE ON FEBRUARY 15 2010 AND THE NOTIFICATION WAS MAILED ON MARCH 5, 2010. OWNERS MAY CONTACT HYUNDAI CUSTOMER ASSISTANCE CENTER AT 1-800-633-5151.

Investigations

2 NHTSA investigations on record

Investigations are agency reviews, not findings that a vehicle is defective.

Hyundai and Kia ABS Module Fires

The Office of Defects Investigation (ODI) has received eight Hyundai Motor America (Hyundai) and eight Kia America, Inc. (Kia) Part 573 Recall Reports between 2016 and 2023. The combined 16 safety recalls all involve the antilock braking system (ABS) modules or Hydraulic Electronic Control Units (HECU) manufactured by the equipment supplier Mando. The Part 573 Recall Reports contain varying defect descriptions and differing remedy descriptions for the same or similar equipment supplied by Mando. Safety recalls included in this Audit Query (AQ) review include: Hyundai recalls 20V-520, 20V-543, 21V-161, 21V-160, 21V-303, 22V-056, 22V-810, and 23V-651. Kia recalls 16V-815, 20V-518, 20V-519, 21V-137, 21V-331, 22V-051, 22V-800, and 23V-652 The purpose of this AQ is to evaluate the timeliness and scoping of Hyundai and Kia’s defect decision making and adherence with reporting requirements; and understand the varying defect descriptions and remedies between these recalls.

Loss of Motive Power

The National Highway Traffic Safety Administration (NHTSA) received a letter dated July 13, 2022, petitioning the Agency to initiate a safety defect investigation into loss of motive power allegations attributed to oil drain pan assembly failures on certain Hyundai Motor America, Inc. and Kia America, Inc. vehicles spanning Model Years (MY) 2005-2021. The Petitioners cited examples of complaints indicating that the subject vehicles were experiencing rapid loss of engine oil due to oil drain plug back outs, resulting in loss of motive power and/or catastrophic engine damage. Additional complaints were provided which alleged that the oil drain pans lack sufficient structural integrity and are susceptible to cracking. The petition itself can be reviewed at NHTSA.gov under ODI number 11481745. On September 12, 2022, the Office of Defects Investigation (ODI) opened Defect Petition (DP22-003) to evaluate the Petitioners’ request. The Petitioners have provided additional complaints within four supplemental letters dated January 31, 2023, March 21, 2023, May 23, 2023, and August 4, 2023. ODI’s evaluation included the review and analysis of the complaints and supporting information submitted by the Petitioners, as well as additional complaints submitted directly to NHTSA which referenced either the oil drain plug or a crack in the oil pan. After reviewing the available data, ODI has not identified evidence that would support opening a defect investigation into the oil drain pan assemblies of the subject vehicles. Based on a review of the available information, a loss of motive power resulting from an oil drain plug back out has not occurred between the initial sale of a vehicle and the completion of its first oil change. If during an oil change service, a technician fails to remove the existing drain plug gasket before installing a new gasket, it is likely that a proper seal between the drain plug and the oil pan will not be made. An improper seal between the drain plug and oil pan could lead to the backing out on the drain plug, resulting in the sudden loss of oil while driving. Additionally, the provided examples of oil pan cracks were localized to the immediate vicinity of the oil drain plug and/or appeared to be the result of direct-contact with a tool during servicing.  There is no information to support that a vehicle-based defect exists relating to the oil pan assembly, and instead the documented incidents are related to the failure to follow the proper maintenance procedures during oil change service. In October 2023, Hyundai published a Technical Service Bulletin (TSB) that provided detailed instructions for oil change service on its gasoline powered vehicles, specifically highlighting the need to remove and replace the existing drain plug gasket prior to reinstalling the drain plug. After a thorough review of the material submitted by the petitioner, the information already in NHTSA's possession, and the potential risks to motor vehicle safety implicated by the petitioners' allegations, NHTSA does not believe that a formal investigation is warranted. Therefore, the petition is denied. A Federal Register Notice (FRN) further detailing NHTSA’s reasons for denial of the petition will be published. The reference numbers for the complaints to NHTSA cited by the petitioner can be found in the petition submission documents in the public file for DP22-003. To review those complaints and the additional complaints ODI added to its evaluation which are cited in the Closing Resume ODI Report Identification Number document, go to NHTSA.gov.
