Electriconic braking moduel with "Check Brake" indication light and"Hybrid System Warning! and vehicle will come to a stop and warning flights will flash until you turn off the vehicle sit for 10-20 minutes. Brakes will not work and vehicle loses power. Battery has been replaced and large 140 fuse in trunk of vehicle and no improvement. KIA states no recall on my vehicle, but my vehicle has had to have recall repairs done on it regardless of not being listed on this site. I need to know what to do. Vehicle is reliable otherwise. Right now, its risky to drive.

Engine faílúre on June 26, 2026.Dies while moving. Engine died while turning from my side street onto busy street and traffic.I could've been struck in the rear had I not pulled out far enough in advance for the traffic to move around me. This is a second engine failure for my Kia. The engine was replaced in December 2023/ January 2024. Incident #11558201. It does not immediately restart. After some time (about an hour) it takes a long time for it to kick over then finally starts. When beginning to move forward it travels approximately 100-150 feet then dies again. A gentleman stopped to see if he could help. He thought the fuel gauge was broken and just needed gas. (Gas tank was full). Then he put the car in neutral and pushed me home with his truck. Then he helped me push it up into my driveway. I haven't gotten to the dealership (Ferguson Imports) Kia because of the cost of towing which I am responsible for if I wish to have it seen by a service specialist. It is available for inspection upon requést.

A issue with the Valve cover gasket leaking into the engine causing a misfire. Making the car suddenly stop while driving which is very unsafe. I took the car to the dealership and they want to charge me for the repairs. I have 2 kia optima hybrid and both cars have the same issue around the same mileage. There were no warning lights during the time it was at the shop. However one day the check engine light did come on and the OBD code P1326 came up. When I took it to the shop the check engine light disappeared and the dealership said they will not check my engine unless they see the code on their end. I believe later down the line the engine will stall out and it should be fixed now while under warranty. However I received no help from the dealership unless I am willing to pay upfront. In addition to this there are electrical issues the front seats aren't moving immediately when the button is pressed. The steering wheel buttons barely work along with the radio. This is a huge problem that needs to be fixed.

Sudden engine failure while driving with no warning. Vehicle began jerking, shaking, and losing power. RPMs dropped unexpectedly and the engine stalled intermittently. Multiple misfire codes were present (cylinders 1, 3, and 4), and the engine was found to have low or no compression in cylinder 1. The condition rapidly worsened to near complete engine failure. The vehicle was operating normally prior to this incident. This failure is consistent with known Kia engine defects involving internal engine damage, including rod bearing failure. This is a safety concern due to sudden loss of power while driving.

When the brake pedal is pressed on the brakes will grab. It snatches the car kinda hard. Also when you give the car gas it will hesitate and will not accelerate. Another with the gas is that you can be driving at a higher speed such as 45 to 55 or so and you press down the gas pedal like your going into passing gear and it will not accelerate it’s like it’s trying to stop. Feels like the car is gonna fall on down onto itself and it loses power.

•I’m not sure what failed, the car was parked. And yes it’s available for inspection. •I had just parked the car coming from work and at the time. If I was in the car any longer than 5 more minutes it possibly could’ve been catastrophic. • All I know as of right now is that 5 days ago, it was escalated and I received a case number and a case manager 3 days ago. •The car has not been inspected •not that I’ve noticed, the engine light was on a week before the accident occurred, after getting off of work and the car system said to check my breaks. I had someone take me home since my car was undrivable. And the next morning I was going to have it towed but everything was working properly. The engine light was gone.

On or around October 17th 2025 I purchased a 2019 Kia OPT un aware that the vehicle had recall problems. Once I realized the vehicle had problems I took it to get it checked out. I only had the vehicle for 2 days before the problems occurred. The Kia service center fixed the recalls all except the bearing failure. They had my car for almost 30 because we went back and forth over this issue. This reason they gave me the reason they couldn’t fix my bearing problem was because I didn’t get it checked out before I had the problem. I didn’t know the vehicle had a problem until the recall came to my attention. I just don’t understand this explanation because it just doesn’t make any sense to me. This model vehicle had a premature bearing wear long before I had this vehicle. It’s a manufactured problem and just because it wasn’t reinstated before the vehicle had the problem Kia will not stand behind the problem with this vehicle and I don’t understand that explanation. Please, please help me get this issue fixed for me please. This has really taken a toll on me and I can’t afford to just junk this vehicle so please help me. Thank you so much for trying to help me with this problem.

The failure involves the component covered under the active safety recall campaign. Recall number : 23V6552 While driving in traffic, the vehicle suddenly began to slow down without warning, started jerking, and lost normal operation. I was forced to pull over to avoid a collision. This sudden loss of power and control placed me, my passengers, and surrounding drivers at risk of an accident. Yes. The issue was confirmed by an authorized dealership. The dealership acknowledged that the problem is directly related to the active safety recall but refused to perform the repair due to vehicle mileage exceeding 150,000 miles. The vehicle has been inspected by an authorized dealership representing the manufacturer. No inspection has been performed by police or insurance representatives at this time. No warning lights or messages appeared prior to the incident. I had not received the recall notification letter at the time I purchased the vehicle. The first occurrence happened suddenly on 12/10/2025, when the vehicle began slowing down and jerking in traffic. After I pulled over and parked, multiple warning lights and messages appeared, and the steering wheel stopped moving normally. This vehicle has an open NHTSA safety recall. Safety recalls do not expire based on mileage or ownership. The dealership acknowledged the issue is recall-related but refused to perform the repair due to mileage limits, which is inconsistent with federal safety recall requirements.

June 26th 2025 my Kia optima 2012 EX quit on interstate 65 in Alabama was towed to dealership 10 days later was requested that I turn in maintenance records which I did. 10 days after that I was contacted and I was told that they could not read some of the records i so resubmitted. No official diagnosis was told they just informed me that the motor would be replaced. They've since removes it from the dealership to a third location. Spoke with Kia consumer affairs in a three-way call to the dealership we were hung up on three times. Trying to find out where the car had been towed to. The car is now at Monrovia towing in Alabama at $40 a day. I have takwn good care of this Kia it falls under all the criteria there were no lights no warning signs it just shut down. Not only was the dealership evasive about their decision or the decision they made me feel as if I had done something wrong when I've only had the car 3 years taken very good care of it had the oil change by fiance the records and receipts of purchase oil. Devastating. Lengthy and financially crippling. I was lead to believe early on that it was a done deal to replace the engine . They accused of fraud in regards to the records. Untrue. This has caused so much stress and anxiety in my life. I am now without transportation. I have a special needs daughter and this car was a lifeline for us. I did nothing wrong I loved this car . I'm now having to let the car go because the towing company is going to auction the car.

The contact owned a 2012 Kia Optima. The contact stated that, while stopped and attempting to complete a left turn an SUV failed to yield and collided with the front driver side of her vehicle. As a result, the contact lost control of the vehicle, spun across the intersection, and careened off the roadway only coming to a complete stop after colliding head-on with a tree. The contact also stated that the seat belt Emergency Locking Retractor failed to deploy allowing her to jolt forward violently and hit her head on the steering wheel. The air bags did not deploy. No warning lights were illuminated. The vehicle was towed to a storage facility but had yet to deemed a total lost by the contacts insurance provider. A police report was filed, and injuries were reported. The contact was later transported to an area hospital and treated for chest pain and neck pain. The contact also received an MRI due to possible concussion. The manufacturer was not notified of the failure. The failure mileage was 84,000.

Dear NHTSA, I am submitting a formal complaint regarding my 2012 Kia Optima, which experienced an engine fire directly related to the defects identified in Kia Safety Recalls SC147, SC200, and SC201. On XXX, my vehicle’s engine failed and caught fire. This is the exact condition covered by the above recalls, which state that affected engines may seize, stall, or ignite. I have been in contact with both a Kia dealership and Kia Consumer Affairs for close to a month without any resolution. The dealership has confirmed that my car requires a complete engine replacement, but Kia has refused to address the recall issue, claiming that other unrelated recalls were not performed. When I previously contacted dealerships to schedule recall repairs, I was told that parts were not available, which prevented me from completing them. In addition to the engine failure, the fire also caused my starter to fail. I was forced to purchase a replacement starter out of pocket, which has added to my financial hardship. I believe I am owed compensation for this expense, as it was a direct result of the safety defect. This situation has caused me severe financial strain, as I relied on my vehicle for work and currently have no income due to its inoperability. Kia has not provided a timeline for repairs, towing coverage, or written confirmation that they remain obligated to remedy this federally mandated safety defect. I am requesting that NHTSA investigate Kia’s refusal to fulfill its recall obligations and intervene to ensure that my vehicle is repaired or replaced in compliance with federal recall requirements. While in park and driving the instrument panel will show, "Check Brake" and "Hybrid System Warning! Safely Stop and Do not Drive". This is accompanied by the engine not responding to the gas pedal. The brake pedal will also loose pressure and once pushed the brakes will lock up making a grinding noise. The problem has not been able to be duplicated by the dealer. However there are multiple forms and online communities dedicated to try to resolve this issue since it's so prevalent. This issue causes a major saftey hazard as the car comes to a grinding halt and does not respond to the driver. From online sources it seems the problem is prevalent across years and models and only tied to hybrid vehicles.

I took my car to the KiaOfLynchburg dealership for get the recalls done and diagnostic test on my engine as it was knocking and they had it since may 06, 2025. The dealership said at first I had a code to get the engine replaced no cost. Now got a phone call on June 19, 2025 saying how my car was on fire but the fire department made it on time to put it out. So did the claim on it they denied me saying it’s due to a aftermarket but tell me it cause of oil leak. And I do not have no aftermarket hook up in the vehicle. Now they won’t take responsibility for the damage they did to my car

On August 25th around 7:00 PM, the vehicle suddenly caught fire while parked after a short test drive. The car had just been purchased a few days prior and was taken to a mechanic for a precautionary inspection. During the test drive, the mechanic parked the vehicle in a residential driveway. After backing in, smoke was observed coming from the engine bay. When the hood was lifted, the engine area was already on fire. The fire department was called immediately and was able to extinguish the flames before the fire spread to surrounding property. The fire completely destroyed the vehicle. The vehicle had no warning lights, unusual performance issues, or prior signs of trouble, and it appeared to be in good condition prior to the incident. This fire posed a serious safety hazard and could have resulted in injury or property damage. Component or system that failed: The engine area, likely associated with the Hydraulic Electronic Control Unit (HECU) fuse/fire risk. The vehicle may or may not be available for inspection, as it is severely burned. Safety risk: The fire posed a serious hazard to the mechanic, surrounding property, and anyone nearby. Rapid ignition could have caused injury or significant property damage. Problem confirmation: The fire was observed firsthand by the mechanic. The open recall related to the HECU fuse/fire risk indicates a known defect consistent with the incident. Inspections: The fire department responded and documented the incident. The vehicle has not yet been inspected by the manufacturer or insurance representatives, but the recall status is verifiable through official records. Had car trailered to a mechanic. He took off oil filter and cut it in half- was full of metal shavings. Said needs new engine. We trailered the car back home, where it currently sits. If the wide spot in the road wasn’t there, they’re likely would have been an accident being this was right on a sharp corner.

The contact stated that while attempting to close the sunroof, the motor failed to function as intended and the sunroof was half closed. The contact had to place a tarp over the sunroof to protect inside the vehicle from the elements. No warning lights were illuminated. Recently the vehicle received maintenance and there was an abnormal knocking sound coming from the engine. In addition, the vehicle failed to accelerate as intended while depressing the accelerator pedal. The contact stated that while driving at slow speeds, the vehicle stalled. The contact was able to coast to the side of the road. No warning lights were illuminated. The vehicle was towed to the dealer, where it was diagnosed and determined that an unknown part had failed in the engine. The contact was unsure what part of the engine had been replaced. The failure recurred, and the contact had safety concerns about the vehicle. The manufacturer was notified of the failure. The failure mileage was approximately 50,000.

Car simply started for me after work this past Thursday @4 pm I dove down the street and for about 5 mins and had to turn around due to me leaving something at work. When I arrived back at work I parked and cut my car off as I normally do and when I returned to start it back up it never did. I have previously been having to add 5 quarts of oil frequently at least once or twice a month for the past 7 months since last year. Was told my car had an oil consumption problem by a previous mechanical shop last year. Noticed that these cars have recalls on them and that my car and year do fit the requirements. I do owned my car with the Title in hand. It’s NOT a salvaged title. I have a service appointment on the 24th of June next Tuesday at Kia of Gastonia located in Gastonia, NC. I have to get my car towed to this establishment on Monday or the morning of my appointment. The contact stated that the manufacturer exceeded a reasonable amount of time for the recall repair. The contact stated that after starting the vehicle and driving approximately 5 minutes, then pulling into a carwash and placing the vehicle in the park, the vehicle lost power and a thick gray smoke began coming from underneath the hood of the vehicle. The vehicle caught fire. The contact was able to exit the vehicle however, the fire had consumed the vehicle, and caused the building the vehicle was parked in front of caught fire. The fire department had put out both fires. The vehicle was towed and deemed totaled. A police report was filed. Subject: Recall Denial Due to Salvage Title – 2012 Kia Optima (VIN:[XXX]) Dear NHTSA, I am submitting a complaint regarding Kia Motors’ refusal to perform a recall repair on my 2012 Kia Optima (VIN: [XXX]) due to the vehicle having a rebuilt title. My vehicle is equipped with the 2.4L GDI Theta II engine, which has been recalled for known safety defects including risk of engine seizure and fire. I brought my car to a local Kia dealership for the recall repair, but they refused service based solely on the vehicle having a branded (salvage) title. I then contacted Kia Consumer Affairs and was again told that the recall does not apply to salvage vehicles—even though the engine defect clearly stems from poor design and is unrelated to any prior accident or title status. I am concerned that Kia is ignoring its obligations under federal recall law and putting drivers like myself at risk. Denying a recall based solely on a salvage title—especially when the defect has nothing to do with the car’s condition—undermines public safety. I was driving home at night around 8pm. I was merging into the slow lane and my car completely lost power. A semi truck was right behind me. Luckily I was able to get over to the emergency lane safely. My car had no acceleration at all or any control of the steering. Prior to this incident there was no problem or warnings of any lights on dash or car having problems. It’s a daily driver for me to work. It’s never gave me any problems prior to this. I’ve had the routine maintenance done on along with the recommended mileage maintenance done. It’s been over a month now and my car still won’t start I haven’t had time to get it towed to a dealer ship or repair shop because I work 17 hour days. Everything I’ve researched about my make and model is starting to indicate that the engine seized up. I really hope that’s now the case because my car will be paid off in 3months. It has 165k miles on it I need help on weather the engine is part of a recall.

The contact stated while the vehicle was parked at the residential driveway and starting the vehicle, smoke started emitting from under the hood. The contact opened the hood and discovered smoke primarily emitting from the front passenger side of the vehicle. No warning lights illuminated. There were no injuries sustained. MY VEHICLE HAS 75,583. I received a recall for 3 items and made an appointment and took the car in for the work. I noticed that their wasa slight dead spot in the centeing of the steering and asked if there was any adjustmen. I was told there wasn't but they would check it because there was a known problem thith the plastic gear in the electric motor's connection to the rack that wears out and can completely disintegrate. when I picked up the vehicle they had obviously checked it because the slight dead spot had turned into a clunk. As there was no recall they would nothing about it as the vehicle was out of warranty (10 years, 100,000 miles). Had it had a higher annual mileage it would have been replaced under warranty. My concern is that this fault may be hidden by the warranty coverage. If the plastic gear fails completely the steering could become locked or inoperable. This is clearly a well known problem as there is a youtube video showing the replacement process. This actual mechanism may be used on several other years and models. Kia Motors America (Kia) is recalling certain 2010-2013 Kia Forte, Forte Koup, 2011-2013 Kia Optima and 2011-2012 Kia Optima Hybrid and Sedona vehicles. In the event of a crash, the air bag control unit (ACU) may short circuit, preventing the frontal air bags and seat belt pretensioners from deploying.
Risk: If the frontal air bags and seat belt pretensioners are disabled, there is an increased risk of injury to the vehicle occupants in the event of a vehicle crash that necessitates deployment of these safety systems.
Remedy: Kia will notify owners. For model year 2011 Sedona vehicles, Kia will instruct dealers to verify the ACU part number and, if necessary, install an extension wire harness kit between the ACU Connector and the Vehicle Harness Connector. For all other affected vehicles, Kia will instruct dealers to install the extension wire harness kit. The recall began September 28, 2018. Owners may contact Kia customer service at 1-800-333-4542. The Office of Defects Investigation (ODI) has received eight Hyundai Motor America (Hyundai) and eight Kia America, Inc. (Kia) Part 573 Recall Reports between 2016 and 2023. The combined 16 safety recalls all involve the antilock braking system (ABS) modules or Hydraulic Electronic Control Units (HECU) manufactured by the equipment supplier Mando. The Part 573 Recall Reports contain varying defect descriptions and differing remedy descriptions for the same or similar equipment supplied by Mando. Safety recalls included in this Audit Query (AQ) review include: Hyundai recalls 20V-520, 20V-543, 21V-161, 21V-160, 21V-303, 22V-056, 22V-810, and 23V-651. Kia recalls 16V-815, 20V-518, 20V-519, 21V-137, 21V-331, 22V-051, 22V-800, and 23V-652 The purpose of this AQ is to evaluate the timeliness and scoping of Hyundai and Kia’s defect decision making and adherence with reporting requirements; and understand the varying defect descriptions and remedies between these recalls.
The National Highway Traffic Safety Administration (NHTSA) received a letter dated July 13, 2022, petitioning the Agency to initiate a safety defect investigation into loss of motive power allegations attributed to oil drain pan assembly failures on certain Hyundai Motor America, Inc. and Kia America, Inc. vehicles spanning Model Years (MY) 2005-2021. The Petitioners cited examples of complaints indicating that the subject vehicles were experiencing rapid loss of engine oil due to oil drain plug back outs, resulting in loss of motive power and/or catastrophic engine damage. Additional complaints were provided which alleged that the oil drain pans lack sufficient structural integrity and are susceptible to cracking. The petition itself can be reviewed at NHTSA.gov under ODI number 11481745. On September 12, 2022, the Office of Defects Investigation (ODI) opened Defect Petition (DP22-003) to evaluate the Petitioners’ request. The Petitioners have provided additional complaints within four supplemental letters dated January 31, 2023, March 21, 2023, May 23, 2023, and August 4, 2023. ODI’s evaluation included the review and analysis of the complaints and supporting information submitted by the Petitioners, as well as additional complaints submitted directly to NHTSA which referenced either the oil drain plug or a crack in the oil pan. After reviewing the available data, ODI has not identified evidence that would support opening a defect investigation into the oil drain pan assemblies of the subject vehicles. Based on a review of the available information, a loss of motive power resulting from an oil drain plug back out has not occurred between the initial sale of a vehicle and the completion of its first oil change. If during an oil change service, a technician fails to remove the existing drain plug gasket before installing a new gasket, it is likely that a proper seal between the drain plug and the oil pan will not be made. An improper seal between the drain plug and oil pan could lead to the backing out on the drain plug, resulting in the sudden loss of oil while driving. Additionally, the provided examples of oil pan cracks were localized to the immediate vicinity of the oil drain plug and/or appeared to be the result of direct-contact with a tool during servicing. There is no information to support that a vehicle-based defect exists relating to the oil pan assembly, and instead the documented incidents are related to the failure to follow the proper maintenance procedures during oil change service. In October 2023, Hyundai published a Technical Service Bulletin (TSB) that provided detailed instructions for oil change service on its gasoline powered vehicles, specifically highlighting the need to remove and replace the existing drain plug gasket prior to reinstalling the drain plug. After a thorough review of the material submitted by the petitioner, the information already in NHTSA's possession, and the potential risks to motor vehicle safety implicated by the petitioners' allegations, NHTSA does not believe that a formal investigation is warranted. Therefore, the petition is denied. A Federal Register Notice (FRN) further detailing NHTSA’s reasons for denial of the petition will be published. On March 29, 2019, the Office of Defects Investigation (ODI) opened two Preliminary Evaluations (PE19-003 on Hyundai and PE19-004 on Kia) to broadly investigate incidents of non-crash fires (regardless of origin or operational status of the vehicle) on various model year Hyundai and Kia vehicles. During the PE investigations, Hyundai and Kia issued several recalls to address vehicle fires, including those due to engine failures involving various engine types. The remedies for the engine failure recalls typically involve engine inspection (to detect existing damage), and if necessary, engine replacement. Additionally, both manufacturers have been installing an engine control software modification known as Knock Sensor Detection Software (KSDS) which is intended to detect impending engine failure, alert the driver, and limit engine power (to lessen likelihood of engine failure).KSDS is being installed under recalls and non-safety field actions, and both companies have extended limited engine warranties (see recall files). On December 22, 2021, ODI upgraded PE19-003 and PE19-004 to this Engineering Analysis (EA21-003, covering both Hyundai and Kia) to evaluate the scope of the prior recalls related to engine failures/fires and the efficacy of the recall remedies for the recalls, as well as the long-term viability of related programs and non-safety field actions being conducted by Hyundai and Kia. The former issue involved approximately 550,000 MY 2013 Hyundai Elantra, MY 2011 Kia Sorento, and MY 2012-2015 Kia Rio. The latter issue involved approximately 2.5 million recalled vehicles, which have been identified as displaying potential remedy concerns: Hyundai recalls 15V-568, 17V-226, 20V-746, and 21V-727; and Kia recalls 17V-224, 19V-120, 20V-750, and 21V-844. Regarding the recall scope issue, among all of the scope vehicles identified at EA opening, ODI found only the MY 2011 Kia Sorento vehicles equipped with both the Theta II 2.4L 4-cylinder Multi-Point Injection (MPI) and the Lambda II 3.5L 6-cylinder MPI engines experienced relatively high rates of reported fires. In December 2023, Kia issued recall 23V-877 that will cover about 80,000 MY 2011 Kia Sorento vehicles equipped with the Theta II 2.4L MPI engines. The remedy will involve an inspection, and if necessary, a replacement of the engine, as well as the installation of KSDS. It should be noted that in 2021 these vehicles were included in a KSDS product improvement campaign with warranty extension. For the MY 2011 Sorento vehicles equipped with the Lambda II 3.5L engines, ODI believes that future engine failures/fires involving these vehicles will likely be due to a lax in adhering to the proper or scheduled engine maintenance (regular engine oil changes), rather than a design or manufacturing engine issue. Regarding the issue of the efficacy of the recall remedies, ODI found the majority of the recalled Hyundai and Kia vehicles, by model, experienced lower reported fire rates after the remedies were applied. Furthermore, ODI found that for most vehicles that did not receive the recall remedies, by model, experienced relatively high fire rates. To address this problem, Hyundai informed ODI in December 2023, that it will renotify all of its owners covered by the Hyundai recalls of engine failures/fires every 8 months for the next 3 years. In December 2023, Kia stated that it will renotify the majority of its owners every 8 months for the next 3 years.Several previously recalled Kia models are excluded from the renotification due to their lower reported rates of engine fires. Overall, the renotification actions will help to increase the recall completion rates, thus reduce the frequency of engine fires in the future. In view of the recall action being taken by Kia and renotification actions being taken by both Kia and Hyundai, ODI is closing this Engineering Analysis. Also, both companies have been released from the 2020-iniated Consent Orders (Kia since November 2022 and Hyundai since November 2023). The agency reserves the right to take additional action if warranted by future circumstances. The Office of Defects Investigation (ODI) of the National Highway Traffic Safety Administration (NHTSA) received a petition letter dated October 10, 2021, requesting an investigation of possible defects in the electronic throttle control (ETC) system on certain Kia vehicles resulting in the opening of DP21-003. Accordingly, Model Year (MY) 2005-2016 Kia Optima/K5, MY 2006-2015 Kia Sorento, MY 2007-2016 Hyundai Elantra, MY 2007-2016 Hyundai Santa Fe, MY 2006-2015 Hyundai Sonatas are all part of the subject population. The petition was originally filed as a Vehicle Owner Questionnaire that can be reviewed at NHTSA.gov under reference (ODI) number 11439675.On November 12, 2021, ODI opened Defect Petition DP21-003 to evaluate the petitioner?s request. ODI performed trend analyses of the VOQs related to vehicle speed control issues for all the subject vehicles and found that none of the 52 Model/Model Year Hyundai/Kia vehicles demonstrated any actionable trend that warranted an investigation.Petitioners submitted 1119 VOQs and non-VOQ cases in which sudden uncommanded acceleration (SUA) or loss of motive power (LOMP) incidents were alleged.For the 1119 reports, 220 were incidents involving crashes, from which 69 subject Hyundai-Kia vehicles were inspected by Hyundai/Kia dealer technicians, Hyundai/Kia engineers, and/or third-party representatives.ODI found the inspections identified no vehicle defects related to the ETC system.Of the 220 crash-involved reports, 13 Event Data Recorder (EDR) records were downloaded successfully and 11 of those indicated driver error: (i.e.) pedal misapplication.A condition where the accelerator pedal is mistakenly applied instead of the brake pedal when the driver wants to stop the vehicle.In addition, ODI reviewed a scientific journal paper published in Forensic Science International in 2016 by Mr. Park et al ., as well as related test videos. ODI does not believe there is any evidence of uncontrollable SUA occurrences in any of the tests reviewed. NHTSA's Office of Vehicle Safety Compliance (OVSC) reviewed the allegations regarding the potential noncompliance with Federal Motor Vehicle Safety Standard No. 124.Based on the information provided, the Agency concludes there is insufficient information for us to determine if a possible non-compliance exists.Finally, both Hyundai and Kia informed ODI that all their vehicles manufactured after 2012 were equipped with an ETC management system, in which the engine speed will go to idle when the system sees signals from both the brake pedal and accelerator pedal at the same time; this is commonly known as the brake-throttle override system.After thoroughly assessing the material submitted by the petitioner, information already in NHTSA's possession, information submitted by Hyundai and Kia in response to an Information Request letter, and the potential risks to safety implicated by the petitioner's allegation, NHTSA does not believe that a formal investigation is warranted. After full consideration of appropriate factors, the petition is denied. A Federal Register Notice (FRN) further detailing NHTSA?s reasons for denial of the petition will be published.
During this Preliminary Evaluation (PE), the Office of Defects Investigation (ODI) assessed the scope, frequency and potential safety-related consequences of non-crash vehicle fires caused by both engine failures and failures of other vehicle systems/components in model year (MY) 2011-2014 Kia Optima, MY 2011-2014 Kia Sorento and MY 2010-2015 Kia Soul vehicles equipped with Theta II, Gamma, Nu and Lambda II engines (approximately 1.7 million vehicles). In a letter dated June 11, 2018, the Center for Auto Safety (CAS) petitioned the National Highway Traffic Safety Administration (NHTSA) to initiate a safety defect investigation into non-collision related fires on model year (MY) 2011-2014 Kia Optima and Sorento, and Hyundai Sonata and Santa Fe vehicles. In a letter dated July 24, 2018, CAS requested that MY 2010-2015 Kia Soul vehicles be added to the petition. CAS stated that there is a higher number of complaints to NHTSA regarding non-crash fires on these vehicles compared to other similar vehicles. The Office of Defects Investigation (ODI) had already opened Recall Queries (RQ17-003 and RQ17-004) on all Kia and Hyundai vehicles equipped with Theta II engines for engine failures that may cause stalling and fires.The queries cover most of the petition subject Optima, Sorento, Sonata, and Santa Fe vehicles but not any of the subject Soul vehicles.On August 21, 2018, ODI opened a Defect Petition (DP18-003) to evaluate whether to grant or deny the CAS petition. ODI sent Information Request letters to Kia and Hyundai (September and October 2018) requesting information on all engine and non-engine related fires in the petition vehicles.ODI performed extensive analysis on the information obtained from Kia and Hyundai. During the DP18-003 analysis, Kia and Hyundai each initiated three additional safety recalls related to engine compartment fires on certain petitioned and non-petitioned vehicles (nearly 740,000 total vehicles: Recalls 18V-907, 18V-934, 19V-101, 19V-063, 19V-120, and 19V-204). Based on ODI?s review of the applicable materials, including responses to Information Requests sent to multiple manufacturers, Vehicle Owner Questionnaires (VOQ), and Early Warning Data, NHTSA decided to grant the petition.The CAS petition was granted on March 29, 2019. Preliminary Evaluations (PE19-003 on Hyundai and PE19-004 on Kia) have been opened to assess the scope, frequency, and potential safety-related consequences of alleged defects relating to non-collision vehicle fires in the 2011-2014 Kia Optima and Sorento, 2011-2014 Hyundai Sonata and Santa Fe, and 2010-2015 Kia Soul.Attached is a list of the reference numbers for the 404 VOQs cited above.
NHTSA opened Recall Query (RQ) 17-003 to investigate the timeliness and scope of Kia?s Theta II GDI engine recall (Recall No. 17V-224), and Kia?s compliance with reporting requirements. On November 23, 2020, the Agency entered into a Consent Order with Kia to administratively resolve NHTSA?s assertions of violations of law in connection with RQ17-003. NHTSA?s assertions included that Kia may be liable for civil penalties on multiple grounds, including that Recall No. 17V-224 was untimely and Kia?s recall report contained certain inaccuracies.Under the Consent Order, Kia agreed to a total civil penalty of $70,000,000. The total civil penalty included a payment of $27,000,000 as a Non-Deferred Amount.Kia also agreed to a sum of $27,000,000 as an Abeyance Amount to be deferred and held in abeyance pending its satisfactory completion, as reasonably determined by NHTSA, of the requirements of the Consent Order.Kia also agreed to a $16,000,000 Performance Obligation Amount to be expended by Kia to fulfill specified Safety Data Analytics Infrastructure obligations. The Consent Order also includes other terms designed to enhance Kia?s safety practices, and requires Kia to retain a Third-Party Auditor who directly reports to NHTSA.Other than RQ17-003, the Consent Order is not intended to affect any other current or future investigation of NHTSA which may involve vehicles equipped with Theta II GDI engines. In particular, Engineering Analysis (EA) 21-003 (which is upgraded from Preliminary Evaluation (PE) 19-004) continues NHTSA?s evaluation of certain performance and design issues relating to the Theta II and other engines.Nothing in the Consent Order discharges Kia from any obligation to comply with the Safety Act or regulations thereunder, including the obligation to carry out recalls in accordance with the law, and to initiate a recall upon any future determination by Kia, or upon any finally adjudicated order from NHTSA, that vehicles equipped with Theta II GDI engines contain a defect related to motor vehicle safety or do not comply with an applicable FMVSS.This RQ is closed. Closure of this RQ has no bearing on the terms of the Consent Order, including Kia's ongoing performance obligations, and does not represent a determination by the agency as to Kia's performance under the Consent Order to date.
