As I was backing out of the driveway I heard a strange noise and the steering started feeling crunchy. I parked the car and when I got out I saw a very large bolt on the ground that appears to have dropped out of the car. This seems to be the same issue as described in safety recall 23V-235. Tesla is saying my vin isn’t included and not covered despite the safety recall expiring including this manufacturing date range.

The contact stated that while driving on a highway at approximately 70–80 MPH, the hood latch failed, causing the hood to unexpectedly open and strike the windshield, obstructing the driver's visibility. Both the hood and the windshield were damaged. No warning lights illuminated and no unusual sounds occurred prior to the failure. The contact was able to safely pull over to the shoulder of the road. The contact temporarily secured the hood using tools kept in the vehicle and drove to the residence. An appointment was scheduled with a Tesla Collision Center for inspection and repairs. The manufacturer was notified of the failure and referred the contact to the collision center. The failure mileage was approximately 58,700.

In the last 18 months I have had 8 service visits relating to electrical issues. In the last 30 months: - I had my car computer replaced after it shorted out, and then had to have it replaced again the next week. - I had the same taillight short out twice in a row. - I have had the 12V battery replaced three times. - I have had multiple low voltage controllers short out over multiple service visits. - The sound system has shorted out once as well. - One time, I was unable to shift to drive because a heater had shorted out. Now, I have to replace my right headlight and passenger airbag occupancy sensor due to shorts as well. The right headlight goes out intermittently and the passenger airbag alert fires sometimes. Tesla Corte Madera submitted a buyback request on my behalf after witnessing all these issues, but Tesla corporate denied it. I am sure the electrical issues will continue to affect the safety and drivability of my car. Thank you for your help.

My car experienced a loud clunking noise when turning for the past few weeks. After doing some research and inspecting behind the front right tire, I found a front suspension lateral link bolt nearly falling off. It was only being held on by a few threads. It was so loose I could unscrew it completely or tighten it more by hand with no resistance. It sounds related to an existing recall for 2018 Tesla model 3’s (my year and model), but my car is not included in the recall. The other joints around it appear prematurely worn as well. See picture to show exactly how loose it was upon inspection. Requesting to review and likely expand the existing recall to more 2018 Tesla Model 3s

Tesla notification that front left safety restraint system has an issue. Service is required. Who isn't going to take their car in when there is an alert saying the safety restraint system has an issue. Then $232 in parts and $484. in labor. After taking in it was diagnosed that seat harness being pinched against the outboard shield causing the pretensioner to fault. Need to replace the seat harness and the pretensioner. Ended up being $232 in parts and $484 in labor. My safety was at risk because this system affects the seatbelt and airbags. Problem was diagnosed, confirmed, and repaired at my cost. Tesla dealership inspected. Thousands of tesla owners repairing at their own cost- maybe should be recall.

My vehicle should've been included in a recall. While exiting my garage to pick up my son from school, a loud mechanical banging noise came from the front of my car. I abruptly stopped and proceeded to reverse back into my garage to inspect my vehicle. While inspecting my vehicle and the surrounding area, I discovered a large bolt on the ground. A quick image search says "on a Tesla Model 3, this specific high-strength 10.9 Class metric hex flange bolt is a critical structural component that almost certainly backed out of [my] front suspension lower control arm/ lateral link assembly or the front subframe structural mounts." So the loud banging noise came from my suspension falling apart after the bolt fell out. Upon further inspection, I confirmed that this was the issue and that a second bolt on the same side had partially backed out as well. My vehicle was not safe to drive, so I had to have my vehicle towed to the nearest service center for repairs. I took photos and video of the areas, as well as the bolt, which showed no signs of any damage to the head or threads - so the bolt simply backed out and appears to be a manufacturing/ assembly issue. After a quick search, we learned that there were previous NHTSA recalls (ie Part 573 Safety Recall Report 23V-235) for this particular issue, including for my same vehicle make, model, year (2018 Tesla Model 3) and production dates (Jan 5, 2018 - Mar 30, 2019). Unfortunately, I never received a recall notice. I barely drive my car, so bolts shouldn't just be backing out on their own. Unfortunately, my car is no longer under warranty, but was advised by the service managers to file a report and to get reimbursed thru NCDS. This is a huge safety issue. I had no warnings or alerts from the car. My alignment was checked a year ago. My wheels and tires get checked often and are well maintained, so I didn't even need air or rotation, yet my suspension just fell apart on its own before 60K miles.

Vehicle also threw BMS_a085/a086 Pack and Fast Charge Contactor Mismatch codes. Tesla service is refusing to cover repair under the 8-Year HV Battery Warranty, claiming fast charge contactors are not a warranted component despite being integrated into the HV battery assembly. Vehicle has been at Duluth, GA Tesla Service Center since approximately June 8, 2025.

I have received a dashboard warning from Telsa that there is a “Front passenger safety relevant safety issue”. Upon follow-up with the Tesla service team, I’ve learned that the sensor has failed and since they can only replace it with a new and different type of sensor, they also need to replace the air bag. The initial cost was estimated at some $2,100. I bought the “2018” Tesla Model 3 in 2019. I’ve never had to replace an air bag in my some 40 years of owning a car. I hope this is helpful info for NHTSA to have. Please let me know if you have any questions.

The front passenger safety restraint system is triggering an on-screen warning error that says service is required. This puts my front passenger at risk of death in the event of an accident. I have sent the manufacturer (Tesla) a request for service and received a confirmation of the errors with a list of parts to be replaced for a sum of $1200.65. I understand there is a service bulletin for this issue (Bulletin SB-19-20-003), but Tesla still will not fix it for free even though it is a safety issue. After an over the air software update this past week 2026.14.6 my Tesla Model 3 power steering has failed. EPAS shows ACTICE in service mode, calibration was successfully completed and there are no active EPAS/rack faults. Power steering assists at higher speeds but fails below 20mph. Tesla has a history of steering related software problems and needs to take ownership of the problem.

Tesla model 3 2018 long range 86k miles. While driving 50mph on freeway the lower control arm link separated from the frame. No impact, no damage, and no pothole/bump. Lost steering and was able to get to side of road. When I got out and look at vehicle the control arm was disconnected from the frame. The frame showed no damage and the control arm showed no damage. The mounting holes for each here intact and no damage. Appears that bolt fell out or sheared off and the control arm disconnected. This is a safety failure and was scary. I towed to Tesla and they claim that failure was form worn parts and tolerances. I stated how could this be worn parts when mounting holes are in excellent condition. They are refusing to help with cost of repair and quoted me $2800. They are not taking responsibility and I believe that others should know of this failure. I believe I am being wronged and would like to report. Thanks.

Potential safety defect: high-voltage battery and battery management system (BMS) appear to overestimate available energy and remaining range, creating risk of unexpected 0% state of charge or loss of motive power without warning. Across 20 documented charge/discharge cycles between January and May 2026, the vehicle has consistently delivered approximately 135-150 miles of real-world range against an EPA-rated 310 miles, under routine driving conditions. The vehicle's own energy display shows observed usable energy averaging approximately 49.93 kWh -- approximately 66.6% of the rated 75 kWh pack. Tesla/BMS diagnostics report approximately 79-80% pack retention, implying approximately 58-59 kWh available -- approximately 8-9 kWh more than the vehicle's own consumption display reflects. No BMS fault code, low-power alert, or driver warning has been generated despite this persistent discrepancy. On April 22, 2026, after a drive, the vehicle was parked showing approximately 3% SOC and 7 miles remaining. Approximately five hours later, while parked and not being driven, the vehicle displayed 0% SOC and 0 miles. No fault or warning was triggered. Supporting photographs document the same low-SOC discharge cycle: vehicle at 27%/65 miles on April 20 and at 0%/0 miles on April 22. A driver relying on 3%/7 miles as a margin to reach a charging location could become unexpectedly stranded. If a similar BMS recalculation occurred while driving at low SOC, the result could be sudden unexpected loss of motive power -- a potential roadway safety hazard before the driver receives adequate warning. On May 14, 2026, Tesla Service performed a battery health review (Invoice 3000S0016915237) documenting 79% pack retention, no faults found, no further action. Test name, methodology, and whether the review evaluated BMS calibration accuracy or low-SOC energy availability were not disclosed.

The control arms on all make and models of tesla have a horrible design that all water off of the car flows down the sides of the front hood and down onto the control arm bushing. This could be a simple fix for tesla to out a boot on it to cover the bushing. The control arms start to fail at any given time. This is costing owners thousands of dollars. I have had to had them replace once under warranty and now they want me to pay 2000 since I am out of warranty. Owners with newer vehicles sometimes start to have problems within the first year. This part design needs to be recalled and all persons have free repairs. According to sources, driving with severely worn control arm bushings can lead to a fatal accident. While bushings often start as a minor nuisance, complete failure compromises the structural integrity of your vehicle's suspension. Don't wait till deaths start happening. Protect the customer and others and send a recall on this. Yiu can Google tesla control arm issues and and see over and over in videos and forums that this is a major issue.

Within the last 7 days, my 2018 Tesla Model 3 Long Range AWD began displaying active alerts for two separate safety system failures: (1) alert code UI_a020 / GTW_w075 — Steering Assist Reduced, stating steering may require increased effort, and (2) alert code RCM_a056 — Front Passenger Safety Restraint System Issue, requiring service. The steering alert appeared intermittently, firing at consistent times of day suggesting a possible electrical or sensor fault rather than mechanical failure. On one occasion during startup, the steering system briefly locked up before resuming normal function. No noticeable change in ongoing steering feel has been observed while driving. The passenger restraint system alert indicates the front passenger airbag and Occupant Classification System (OCS) may not function properly in the event of a collision, directly endangering any front passenger. Both issues have been confirmed by the manufacturer via remote diagnostic review, and two separate service estimates totaling approximately $4,784 have been issued recommending replacement of the steering rack, front passenger airbag, occupant classification sensor, seat harness assembly, and seat cushion assembly. Notably, the manufacturer has not physically inspected the vehicle — both estimates were generated solely based on alert codes read remotely and "AI" according to a representative. The manufacturer's own customer support system indicated these repairs may qualify for goodwill coverage, yet no formal commitment has been made. The passenger airbag and restraint system failure is of particular concern as it represents a potential inability of a primary safety system to deploy correctly in a crash event. The component is available for inspection upon request. The vehicle has not been inspected by police or insurance representatives. Warning alerts remain active and ongoing.

Safety Issue: Defective interior cabin camera causes Tesla Full Self-Driving (FSD) to disengage abruptly and without adequate warning at freeway speeds. I am a [XXX] driver. I purchased FSD capability with this vehicle in December 2018. In October 2025, I had the FSD hardware upgrade (HW2.5 to HW3) installed at Tesla's Encinitas, CA service center (B.A.R. License [XXX] ). Within days, FSD would became completely unusable due to a recurring "Cabin camera unavailable — schedule service" alert that instantly disengages the system. The disengagement occurs on the freeway at highway speed, without meaningful advance warning. As a [XXX] driver, the sudden loud alarm and loss of assisted driving is genuinely alarming — it is not immediately clear in the moment whether the vehicle has lost power or experienced a critical failure. This is exactly the kind of dangerous situation driver assistance systems should prevent, not cause. Tesla's own diagnostic confirmed the defect (Diagnostic Invoice No. XXX, November 27, 2025, Encinitas service center): "Cabin camera unavailable" alert verified Intermittent stream exit faults detected in the selfie/cabin camera Low-voltage circuit and wiring checks were normal — ruling out wiring Conclusion: fault is within the camera module itself; technician recommended replacement The defect is FSD-specific. The cabin camera works correctly for Sentry Mode, live security viewing, and all normal driving. It fails exclusively when FSD is engaged and demands sustained driver monitoring. The camera housing also becomes extremely hot to the touch during FSD use, consistent with reports from other 2018 Model 3 owners describing identical symptoms after their HW3 retrofits. The front lateral links, compliance links, and stabilizer bar link on my 2018 Tesla Model 3 Long Range failed and required replacement in January 2026. Prior to failure, abnormal creaking and clunking noise from the front suspension began appearing weeks before the repair — no warning lights illuminated at any point. The failed components were replaced by a Tesla-certified Service Center and are no longer available for inspection. The failure was confirmed and repaired solely by the Tesla Service Center; no police, insurance representatives, or other parties inspected the vehicle. I was charged out of pocket for this repair. The lateral link separation risk directly endangers vehicle safety — if a fastener loosens sufficiently, the lateral link can detach from the subframe, causing sudden wheel misalignment and loss of steering control, which could result in a crash at any speed. Tesla issued recall 23V-235 (NHTSA campaign 23V235000) in March 2023 for this exact condition on 2018-2019 Model 3 vehicles. My vehicle's VIN was not included in the recall population, yet experienced the identical failure mode. I am requesting this complaint be considered for recall expansion under 23V-235 and seeking reimbursement for out-of-pocket repair costs for a defect Tesla has already acknowledged in identical vehicles.

The contact stated that the error message had been displayed intermittently. Upon investigating the failure online, the contact related the failure to the seat adjustment feature. I am submitting this report to the National Highway Traffic Safety Administration regarding a recurring safety issue with my 2018 Tesla Model 3 involving unintended “phantom braking.” On multiple occasions, my vehicle has abruptly decelerated without any apparent obstacle or hazard present. These incidents have primarily occurred while using driver assistance features such as Autopilot and Traffic-Aware Cruise Control on highways and well-marked roads under normal driving conditions (clear weather, dry pavement, consistent traffic flow). The braking events are sudden and significant, creating a serious safety risk—particularly when other vehicles are following closely. In several instances, the deceleration was forceful enough that I believed a rear-end collision was likely. There were no visible triggers such as overpasses, shadows, vehicles merging, or roadside objects that would reasonably justify the system’s response. Below are details to assist your investigation: •Driver Assistance Features Active: Just cruise control, not auto pilot on these occasions •Weather/Road Conditions: Clear and dry •Frequency of Occurrence: This is an ongoing problem that has occurred dozens of times in the past few years. The March 30th incidents were only the most recent ones. •Any Warning Messages or Alerts: No This behavior appears unpredictable and difficult to anticipate or mitigate, increasing the risk of a crash. Given the potential safety implications, I respectfully request that NHTSA review this issue to determine whether it reflects a broader defect affecting other vehicles. My hard brake lines were corroded and had to be replaced on a 7 year old model 3 with 70k miles on it. The cost was over $4000 as battery has to come out and it's very labor intensive. Tesla offered no help with paying for this. They tried to say the car probably was in a very corrosive environment before I bought the car (I purchased it about a year ago). However, I've seen little to no corrosion anywhere on the car. I've decided to report this issue after talking with several lifelong mechanics who have said they have never heard of hard brake lines failing on a car with age and mileage that mine has. Also after searching owner groups I've heard from other owners that have had this same issue and it seems like a growing number especially in early model 3 cars. I was giving a warning about low brake fluid and advised not to drive the vehicle before getting it inspected.

Once the traffic cleared the car drove right through the red light and I was given a traffic citation by a police officer. The car did wait until there were no other cars present so I don't believe I was in any real danger but the fact that the car went through a red light while on full self driving violates the rules of the road which as we know is illegal. I have a video from my dash cam but this form doesn't appear to allow for video uploads.

The front lower lateral link (rearward lower control arm) fastener/bolt completely backed out and fell off the vehicle while in motion, causing the lateral link to separate entirely from the subframe. This is the exact mechanical failure described in Tesla Recall Campaign 23V-235 (Service Bulletin SB-23-31-001), however, my specific VIN was not included in that recall. The vehicle and components are currently at an independent EV repair facility and are available for inspection upon request. Photographic evidence of the missing bolt and separated control arm has been retained. The separation of the lower lateral link caused an immediate and violent collapse of the front passenger-side suspension geometry. The affected wheel was no longer anchored to the vehicle frame, causing it to fold backward and grind heavily against the wheel well. To keep the vehicle moving straight, the steering wheel had to be turned to an extreme 45-degree angle. This resulted in a near-total loss of steering control. Had this fastener failed while traveling at highway speeds instead of low speeds, it would have resulted in an uncontrollable, catastrophic collision. Yes. The problem was physically confirmed and documented by an independent, EV-certified repair facility (EVFixMe/Shocker Motors in Costa Mesa, CA) once the vehicle was placed on a lift. The vehicle was physically inspected by an independent service center. The manufacturer (Tesla) was contacted via the Tesla App; however, they refused to perform a physical diagnosis without pre-authorization of a 2,600 comprehensive suspension replacement estimate and stated the vehicle was out of warranty with no open recalls. There were no dashboard warning lamps, digital alerts, or error messages from the vehicle's computer system prior to the failure. The failure presented suddenly as a loud, painful metal-on-metal grinding noise accompanied by immediate, severe steering misalignment. Currently waiting on invoice from indy shop.

There is no checkbox for Full Self Driving (Supervised): 3 times in the last 4 weeks, my Tesla has become impatient at long red lights and lurches out into the intersection. I am very concerned because one of those times (first time) it did not creep forward, but just took off thru the red light. I had to accelerate thru to get ahead of those cars that still had the green light. Fortunately, nothing untoward happened, except scaring me! The other two times, I recognized what was happening and put on the brakes and removed from FSD mode. I have complained to Tesla and am asking for them to verify my FSD is up to date and this issue will be fixed. Needless to say, I have stopped using the FSD (Supervised) until this is all addressed.

Description of the Defect: While driving with Full Self-Driving (FSD) engaged, the vehicle's primary computer shuts down and reboots, causing a sudden loss of all safety features, including Blind Spot Monitoring, Lane Departure Warning, Forward Collision Warning, and the driving visualization. The cameras go black while the vehicle is in motion. The Trigger: The failure is triggered by high electrical load. If the Cabin Heater (HVAC) and Seat Heaters are active while FSD is fully computing, the 12V power supply to the computer drops below critical voltage, causing a "Turbo A" processor lockup and system crash. Evidence of Defect: Service Center diagnostics confirmed the specific error code APS_w169_TurboA_SCS_LKUP (Computer Crash) occurred at the exact same timestamp as VCLEFT_a302_blowerGeneralFault (HVAC Blower Failure). This proves a common-mode voltage drop affecting multiple critical systems simultaneously. Manufacturer Response: The manufacturer (Tesla) acknowledged the logs but refused to inspect the wiring harness or ground connections, instead recommending a replacement of the computer unit. However, the failure can be mitigated by unplugging external cameras to reduce load, proving the root cause is an insufficient power delivery design (Wiring/Grounding) rather than a component failure. The computer is running at full load with the newest FSD software and it can no longer keep up with additional loads. Safety Risk: This defect causes a sudden, uncommanded loss of driver assistance and situational awareness tools (cameras/visualization) while the vehicle is maneuvering in traffic. The vehicle’s power distribution system appears insufficient to support the electrical load of the software (FSD) and the hardware (HVAC) simultaneously.

The rear doors are not equipped with manual door releases. In the event of a crash or fire the rear seat passengers would be trapped and would only be able to exit over the front seats and front seat passengers. If the front doors were damaged or front passengers incapacitated the egress for the back seat passengers would be severely impacted. If a fire would occur the situation would be exacerbated. Tesla corrected this condition in later models by installing cable releases for the rear doors. Tesla has not responded with any positive response to our request to provide an upgrade and manual rear door releases.

The squeaky control arm issue in Tesla is well known on the internet with may forums complaining about it. Not sure if there is a safety issue but wanted to report this incase there is a pending case regarding this issue. I was happy to pay for parts but the $570 seem excessive for a 5 year car that had 36k miles.

The front and rear windshields of my Tesla Model 3 developed long cracks requiring full replacement. For over six months, I have been unable to complete these replacements due to repeated failures in the replacement process. The vehicle and damaged glass are available for inspection upon request. My insurance claim was filed with Esurance, and Safelite AutoGlass, Esurance’s designated auto glass provider, has handled all replacement attempts. During this period, three shipments of glass arrived damaged and two shipments were the incorrect glass for my vehicle, resulting in canceled or rescheduled appointments. Safelite has documentation of these failed attempts. Driving with cracked front and rear windshields puts my safety and the safety of others at risk. The damage impairs visibility, especially in rain or low-light conditions, and compromises windshield integrity, which is critical for vehicle structural support and proper airbag deployment. The rear windshield damage also raises concerns about sudden glass failure while driving. The issue has been reproduced and confirmed multiple times by Safelite AutoGlass, an independent service center. While waiting for service, I personally spoke with several other Tesla Model 3 owners at Safelite locations who reported similar experiences, including multiple failed appointments, incorrect glass, and in some cases incorrect installations requiring return visits. This suggests a broader, systemic issue rather than an isolated incident. The vehicle has been inspected multiple times by Safelite AutoGlass, and the issue is documented through Esurance claim records and follow-up complaints I submitted regarding the prolonged lack of resolution. Tesla has not directly inspected the vehicle. There were no warning lights or system alerts prior to the issue. The problem presented as visible cracks that appeared and progressively worsened, prompting replacement attempts beginning approximately six months ago.

Safety Restraint Warning appeared on a 50k miles Tesla Model 3. We are a used electric vehicle dealer in California. This warning has been appearing on parked vehicles repeatedly. Meaning, many of the Model 3's we have listed for sale (over 30 units for sale at any given time) will suddenly have a "Safety Restraint Warning" appear. Tesla is not taking responsibility for this. They always charge the customer. The airbag system is inoperable with this warning. It's a problem on EVERY Model 3 on the road between the year of 2017 to 2020.

I purchased this car new in 2018 and recently replaced the front lateral suspension arm due to worn bushings. During the process, I discovered that one of the 14 mm bolt threads on the right side of the suspension arm had a helicoil inserted. While removal was straightforward, reinstalling the bolt proved difficult. I spent several hours reattaching it to the new suspension arm, but did not apply full torque, as I was concerned about damaging the helicoil or stripping the thread. My main concern is that the factory has stripped the original thread and used a helicoil instead of replacing the affected part. Although the repair has held so far, I am unsure if this is a safe long-term solution, as the helicoil could fail while driving. I contacted Tesla, who advised me to visit their service center. At the Centinela location in Los Angeles, the supervisor informed me that, since the warranty has expired, they can only perform a visual inspection.

Vehicle is 7 years old with 107,000 miles. I received a warning regarding low brake fluid with instructions not to drive the vehicle. Dealer is advising all brake lines are rusted out and need replacement. Rusted lines are apparently causing the brake fluid to leak. I've never heard of any vehicle, let alone a 7 year old vehicle, needing all brake lines replaced. After researching online, my 2018 Tesla Model 3 is not the only Tesla Model 3 with this issue. Specifically, it appears some early 2018 Model 3s have suffered this issue. I believe this is a design defect and safety issue, and that Tesla should be voluntarily repairing affected vehicles with this known issue, since it is a design/safety issue.

The front suspension control arm was completely detached due to unfastened bolts. While this happened on the parking lot at low speed, such detachment at highway speed would certainly lead to major damage, loss of control and injuries or death to the driver. Pictures attached show that the bolts did not have any thread lock applied and simply unscrewed themselves due to vibration. The vehicle was brought to Tesla service, where the owner was charged $3700 for repairs. The customer's complaints that this is a structural/manufacturing problem were ignored by Tesla representatives.

Hello, I have a Tesla model 3 that I bought back in 2018 . On [XXX] when I sliced my finger while opening the door, because the chrome coating on the door handle started peeling. The cut was very deep ( see attached pictures). I contacted Tesla for resolution and they said that the car is not under warranty and I have to pay $340 for each handle to replace them. Apparently the peeling chrome happened to many other Tesla 3 owners and the company is aware of it and they told me that it might be caused by the car washing detergent (?!!) I think it was a defective design and the peeling chrome coating is a major health hazard. The child cand slice their fingers and if person has a bleeding issues and cut themselves while on the road it can be bad. I think it should be treated as a recall for bad design and should be fixed for free. I lost couple of days of work since I work in the Operating room and my finger was severely cut. 1.The component that failed is the load index rating and both inner and outer sidewalls of the tire. Yes, the tires are available for inspection, they are off the car and stored in my garage. 2. I believe the safety of others and my self were at risk, I went for a tire rotation and saw the damage and asked the shop if tires were good and they said its good. Later my father points out this will kill me, so I went back and they offered the replacement warranty with that "tire is free and clear of all liens" claim. :( I refused to sign after reading and bought new tires at tesla and kept the old ones in storage. Also would like to note there website has a gap on warranty manual year after January 1, 2021 to before January 1, 2024 so I'm assuming the newest one is in play. Overall, the safety of others mainly heavy cars like Tesla's are involved. Also the local manger spilled to me that these tires are on Hertz and Enterprise cars, but they might be lighter/cheaper versions then mine. 3. Yes, tesla Tech in Libertyville IL informed me this is a problem and to read my user manual and double check the load index rating. All of which check out correct and don't sound any alarms. 4. no, only firestone and Tesla inspected the tires. 5. No, no warnings besides the cracks forming and getting bigger in the cold weather. Only visual inspection or leak might warn others, but I fear the leak is too late unless parked. Tire size: "235/45R18 94W M+S" from the actual tire. Now that I'm looking at it they are missing the 'P' for passenger.

Tesla, Inc. (Tesla) is recalling certain 2016-2023 Model S, Model X, 2017-2023 Model 3, and 2020-2023 Model Y vehicles equipped with Full Self-Driving Beta (FSD Beta) software or pending installation. The FSD Beta system may allow the vehicle to act unsafe around intersections, such as traveling straight through an intersection while in a turn-only lane, entering a stop sign-controlled intersection without coming to a complete stop, or proceeding into an intersection during a steady yellow traffic signal without due caution. In addition, the system may respond insufficiently to changes in posted speed limits or not adequately account for the driver's adjustment of the vehicle's speed to exceed posted speed limits.
Risk: FSD Beta software that allows a vehicle to exceed speed limits or travel through intersections in an unlawful or unpredictable manner increases the risk of a crash.

The Office of Defects Investigation (ODI) is opening this Engineering Analysis to evaluate Tesla’s Full Self Driving Beta and Full Self Driving (Supervised) (collectively, FSD) degradation detection system. The focus of this investigation will be to assess the system’s ability, when encountering reduced roadway visibility conditions, to detect degradation and alert the driver with sufficient time to respond. ODI will evaluate the performance of FSD in degraded roadway conditions and the updates or modifications by Tesla to the degradation detection system, including the timing, purpose, and capabilities of the updates, and Tesla’s assessment of their safety impact. Tesla’s FSD is an advanced driver assistance system (ADAS) that relies exclusively on vision-based cameras and the related FSD software to detect and respond to the roadway ahead, projecting a path forward based on traffic control devices, vehicles, pedestrians, and the roadway itself. When Tesla began transitioning away from using both cameras and radars to an exclusively camera-based approach, known as Tesla Vision, in mid-2021, it developed and implemented a degradation detection system that it deployed by a software update to existing and new Tesla vehicles. On June 28, 2024, the day after Tesla submitted the SGO report of the November 28, 2023 fatal crash listed in this document, Tesla began developing an update to the degradation detection system. At this time, ODI does not have information on when the update was deployed and which vehicles have the updated system. ODI discussed individual incidents and its initial findings during the PE phase of its investigation with Tesla. As part of those discussions, Tesla’s post-incident analysis indicated that the update to the degradation detection system, had it been installed on the vehicles at the time, may have affected 3 of the 9 incidents identified by ODI. Tesla also described internal data and labeling limitations that prevented a uniform identification and analysis of crash events with the subject system engaged. ODI believes this limitation could have led to under-reporting of subject crashes over portions of the defined time-period. Available incident data raise concerns that Tesla’s degradation detection system, both as originally deployed and later updated, fails to detect and/or warn the driver appropriately under degraded visibility conditions such as glare and airborne obscurants. In the crashes that ODI has reviewed, the system did not detect common roadway conditions that impaired camera visibility and/or provide alerts when camera performance had deteriorated until immediately before the crash occurred. Review of Tesla’s responses revealed additional crashes that occurred in similar environments and where the system either did not detect a degraded state, and/or it did not present the driver with an alert with adequate time for the driver to react. In each of these crashes, FSD also lost track of or never detected a lead vehicle in its path. In upgrading PE24031 to an Engineering Analysis (EA), ODI will gather further information on the updated degradation detection system, including the status of updating vehicles and scope of compatible vehicles, the system’s visibility degradation detection capability, and alerts or warnings to the driver. Lastly, ODI will conduct analysis on six recent potentially related incidents. The Office of Defects Investigation (“ODI”) is opening this Preliminary Evaluation (PE) to assess the scope, frequency, and potential safety consequences of FSD executing driving maneuvers that constitute traffic safety violations. This investigation concerns versions of FSD that Tesla has labeled as "FSD (Supervised)" and "FSD (Beta)." Tesla characterizes FSD as an SAE Level 2 partial automation system requiring a fully attentive driver who is engaged in the driving task at all times. Level 2 partial automation systems are designed to support and assist the driver in performing certain aspects of the driving task, requiring a driver to supervise and intervene as necessary. The driver remains fully responsible at all times for driving the vehicle, including complying with applicable traffic laws. ODI’s investigation will therefore focus, in particular, on whether certain driving inputs within the control authority of FSD forestall the driver’s supervision when they are unexpectedly performed. ODI has identified a number of incidents in which the inputs to the dynamic driving task commanded by FSD induced vehicle behavior that violated traffic safety laws. Although reports of this nature span a variety of behaviors, the reports appear to most commonly involve two types of scenarios. The first type of scenario involves a vehicle operating with FSD proceeding into an intersection in violation of a red traffic signal. The second type of scenario involves FSD commanding a lane change into an opposing lane of traffic. With respect to the first type of scenario, ODI has identified 18 complaints and 1 media report alleging that a Tesla vehicle, operating at an intersection with FSD engaged, failed to remain stopped for the duration of a red traffic signal, failed to stop fully, or failed to accurately detect and display the correct traffic signal state in the vehicle interface. Some complainants also alleged that FSD did not provide warnings of the system's intended behavior as the vehicle was approaching a red traffic signal. ODI has identified six Standing General Order ("SGO") reports in which a Tesla vehicle, operating with FSD engaged, approached an intersection with a red traffic signal, continued to travel into the intersection against the red light and was subsequently involved in a crash with other motor vehicles in the intersection. Of these incidents, four crashes resulted in one or more reported injuries. At least some of the incidents appeared to involve FSD proceeding into the intersection after coming to a complete stop. ODI's pre-investigative work, including coordination with the Maryland Transportation Authority and State Police, indicated that the problem may be repeatable, given that multiple subject incidents occurred at the same intersection in Joppa, Maryland. NHTSA understands that Tesla has since taken action to address the issue at this intersection. With respect to the second type of scenario, ODI has identified 2 SGO reports, 18 complaints, and 2 media reports alleging that a Tesla vehicle, operating with FSD engaged, entered opposing lanes of travel during or following a turn, crossed double-yellow lane markings while proceeding straight, or attempted to turn onto a road in the wrong direction despite the presence of wrong-way road signs. Likewise, ODI has identified 4 SGO reports, 6 complaints, and 1 media report alleging that a Tesla vehicle, operating with FSD engaged, proceeded straight through an intersection in a turn-only lane or executed a turn at an intersection in a through lane despite the presence of lane markings or signals. Complaints also alleged that FSD did not provide warnings of the system's intended behavior. Some complaints alleged that more than one of these failures occurred and, as such, the numbers are not cumulative. Some of the reported incidents appeared to involve FSD executing a lane change into an opposing lane of travel with little notice to a driver or opportunity to intervene. ODI’s review will assess whether there was prior warning or adequate time for the driver to respond to the unexpected behavior or to safely supervise the automated driving task. This review will assess any warnings to the driver about the system's impending behavior; the time given to drivers to respond; the capability of FSD to detect, display to the driver, and respond appropriately to traffic signals; and the capability of FSD to detect and respond to lane markings and wrong-way signage. NHTSA's review will also consider any updates or modifications to the system(s) that may affect the performance of FSD with respect to obeying traffic safety laws and signals. This assessment will focus, in particular, on the types of traffic safety violations described above, as most reports identified thus far have centered around those behaviors. While the behaviors under investigation appear to occur most frequently at intersections, NHTSA’s investigation will encompass any other types of situations in which this behavior may arise, such as when traveling adjacent to a lane of opposing traffic or when approaching railroad crossings. If other evidence received during this investigation involve other types of traffic safety violations, those may be considered as part of this assessment as well. The Office of Defects Investigation (“ODI”) has identified numerous incident reports submitted by Tesla, Inc. (“Tesla”) in response to Standing General Order 2021-01 (the “SGO”), in which the reported crashes occurred several months or more before the dates of the reports. The majority of these reports involved crashes in which the Standing General Order in place at the time required a report to be submitted within one or five days of Tesla receiving notice of the crash. When the reports were submitted, Tesla submitted them in one of two ways. Many of the reports were submitted as part of a single batch, while others were submitted on a rolling basis. Preliminary engagement between ODI and Tesla on the issue indicates that the timing of the reports was due to an issue with Tesla’s data collection, which, according to Tesla, has now been fixed. NHTSA is opening this Audit Query, a standard process for reviewing compliance with legal requirements, to evaluate the cause of the potential delays in reporting, the scope of any such delays, and the mitigations that Tesla has developed to address them. As part of this review, NHTSA will assess whether any reports of prior incidents remain outstanding and whether the reports that were submitted include all of the required and available data. On January 6, 2025, the Office of Defects Investigations (ODI) opened Preliminary Evaluation 24003 (PE24033) to investigate Actually Smart Summon (Summon) sessions resulting in crashes during active sessions. According to Tesla, Summon is a short-distance SAE Level 2 system, controlled by the user from a cell phone within a certain distance and intended for use in parking lots and on private property. ODI analyzed complaint data provided by Tesla as well as complaints submitted to ODI from consumers to identify Summon incidents resulting in crashes. ODI's analysis indicates that almost all Summon reported crashes involved minor property damage claims with no reported incidents involving a vulnerable road user, injury, fatality, or major property damage as indicated by an air bag deployment or vehicle tow away. Out of millions of Summon sessions, a fraction of 1% resulted in an incident. Almost all those incidents took place where, typically early in a Summon session, the system or person using the app failed to fully detect or respond appropriately to vehicle surroundings resulting in minor impacts. Incidents took place when app users did not have a complete 360-degree view of the surroundings in the app to assess situational awareness. This limited the app user’s ability to determine whether an impact was imminent during initial vehicle maneuvers such as reversing in close proximity to an obstacle or a curb. ODI found that the impacts most often occurred with parking gates, adjacently parked vehicles, and short parking bollards. During this investigation, ODI identified two Summon crashes related to camera blockages. In both crashes, Summon attempted to navigate a snowy parking lot with snow partially or fully obstructing the forward-facing cameras. Summon did not detect the camera blockage and the vehicles collided with unoccupied parked vehicles while navigating the parking lot. App users in both instances did not command a vehicle stop or pause despite the obstructed camera visible in the camera stream in the app. On January 15, 2025, Tesla released Over-the-Air (OTA) Software (SW) Update Action numbers 578998 and 579185 for vehicles in service to implement a camera blockage detection condition. Both OTAs improve camera blockage detection mechanisms. Additionally, on January 20, 2025, and January 30, 2025, Tesla identified additional system requirements associated with camera visibility checks and released OTA SW-578752 and SW-580322, respectively. These firmware updates reduce false negative camera blockage detections due to snow or condensation. In its investigation, ODI identified one Summon incident where the vehicle did not yield for a gate arm blocking a garage exit lane and the app user did not command a vehicle stop or pause, resulting in an impact. On February 6, 2025, Tesla deployed OTA SW-578839 to improve vehicle reaction to dynamic gates. This OTA update upgraded vehicle perception systems through a high-fidelity occupancy determination network, which uses data from vehicle sensory systems to improve reconstruction of field objects with high accuracy. On November 20, 2025, Tesla further improved vehicle performance by adding object detections from a separate neural network through OTA SW-580514. Owners of the affected vehicles received all six OTA SW updates. Tesla also released these SW updates to production vehicles. ODI’s findings include information on limitations of the vision-only perception system and updates made in response to known subject crashes. When Tesla began transitioning away from using both cameras and radars to an exclusively camera-based approach, known as Tesla Vision, in mid-2021, it developed and implemented a degradation detection system that it deployed by a software update to existing and new Tesla vehicles. At this time, ODI does not have information on when the update was deployed and which vehicles have the updated system. ODI has discussed individual incidents and its initial findings with Tesla. Based on Tesla’s post-incident analysis, the update to the degradation detection system, had it been installed on the vehicles at the time, may have affected 3 of the 9 incidents identified by ODI. Available incident data raise concerns that Tesla’s FSD system fails to detect and/or warn the driver appropriately under degraded visibility conditions such as glare and airborne obscurants where the camera-based system performance degrades significantly. In the crashes that ODI has reviewed, the FSD system did not detect common roadway conditions that impaired its visibility and/or provide alerts when camera performance had deteriorated until immediately before the crash occurred. ODI is upgrading this investigation (PE24031) to Engineering Analysis (EA) 26002 to further evaluate this matter. The Office of Defects Investigation (ODI) is opening a Recall Query to assess the remedy adequacy of Recall 23V838. On December 12, 2023, Tesla filed a Defect Information Report (Recall 23V838) applicable to all Tesla models produced and equipped with any version of its Autopilot system, which Tesla described as an SAE Level 2 (L2) Advanced Driver Assistance System (ADAS). Autopilot is the simultaneous engagement of Tesla’s Traffic-Aware Cruise Control (TACC) and Autosteer. In describing the safety defect, Tesla’s Defect Information Report (DIR) explained that “the prominence and scope of the system’s controls may be insufficient to prevent driver misuse,” and Tesla committed to the deployment of a multipart remedy aimed at improving system and engagement controls and reducing mode confusion. EA22002 (upgraded from PE21020) was opened to investigate whether Tesla’s Autopilot contained a defect that created an unreasonable risk to motor vehicle safety and involved extensive crash analysis, human factors analysis, vehicle evaluations, and assessment of vehicle control authority and driver engagement technologies. The work conducted in these investigations aligns with Tesla’s conclusion in its 23V838 recall filing. During EA22002, ODI identified at least 13 crashes involving one or more fatalities and many more involving serious injuries in which foreseeable driver misuse of the system played an apparent role. Tesla filed Recall 23V838 to address concerns regarding the Autopilot system investigated in EA22002. Following deployment of the remedy in Recall 23V838, ODI identified concerns due to post-remedy crash events and results from preliminary NHTSA tests of remedied vehicles. Also, Tesla has stated that a portion of the remedy both requires the owner to opt in and allows a driver to readily reverse it. Tesla has also deployed non-remedy updates to address issues that appear related to ODI’s concerns under EA22002. This investigation will consider why these updates were not a part of the recall or otherwise determined to remedy a defect that poses an unreasonable safety risk. ODI is therefore opening this Recall Query investigation to further evaluate the adequacy of the remedy for recall 23V838.

On March 21, 2023, the Office of Defects Investigation (ODI) received a petition requesting a “recall of all Tesla cars” produced from 2013 to the date on which the petition was filed due to what Petitioner considers to be the increased likelihood of pedal misapplication. Attached to the Petition is a paper authored by Petitioner. According to Petitioner, the differences in the operator controls between the subject Tesla vehicles and internal combustion engine powered vehicles promote driver pedal misapplication, leading to sudden unintended acceleration (SUA) incidents. To fix this alleged defect, Petitioner argues that the subject vehicles should be equipped with measures that require: (i) occasional removal of the driver’s foot from the pedals; and (ii) application of the brake pedal before fully stopping the vehicle. ODI evaluated the allegations by, among other things, reviewing the Petition and supporting technical paper, and analyzing Tesla’s response to ODI’s Information Request. ODI is denying this Petition. ODI has not found evidence that warrants the opening of a safety defect investigation into the Tesla vehicles as described in the Petition. The use of regenerative braking controlled by the accelerator pedal, or one-pedal driving, is common across most light vehicle manufacturers of electric vehicles and Tesla vehicles are not unique in this respect. Further, ODI identified only a handful of collisions potentially within the scope of the alleged defect; and corresponding vehicle data demonstrated that the subject vehicles responded appropriately to control inputs by their drivers. Moreover, ODI is unaware of any evidence to suggest that Petitioner’s proposed interlock would have prevented alleged SUA events as apparently described in the Petition and supporting materials. Accordingly, the Agency is denying the petition. As with all potential motor vehicle safety risks, NHTSA will continue to review any new information or incidents as they are submitted to the Agency.
NHTSA received a petition on or about July 18, 2022, requesting that Federal Motor Vehicle Safety Standard (FMVSS) 141 be applied to all electric and hybrid vehicles operating in the United States. The petition can be reviewed at NHTSA.gov under ODI Number 11486072. FMVSS 141 establishes performance requirements for pedestrian alert sounds for motor vehicles. The standard applies to hybrid and electric vehicles that have a gross vehicle weight rating of 4,536 KG or less or are defined as low-speed vehicles. The standard became fully applicable to all such vehicles manufactured on or after March 1, 2021.On January 27, 2023, NHTSA opened Defect Petition (DP) 22-005 to evaluate the subject matter described in the petition. On June 24, 2023 and as supplemented on June 25, 2023, the petitioner notified NHTSA he was withdrawing his petition. The petitioner indicated that, based on his review of data, there is no justification for asserting potential benefits that could be derived from actions sought by my petition. Based on the petitioner's withdrawal, DP22-005 is closed. Closure of this DP does not represent a determination by NHTSA regarding the subject matter of the petition.
The Office of Defects Investigation (ODI) upgraded PE21020 to EA22002 on June 8, 2022, to extend work and deepen the PE21020 crash analysis, to supplement that analysis with additional data, and to perform vehicle evaluations to understand how Tesla’s Autopilot system may exacerbate human factors or behavioral safety risks by undermining the effectiveness of the driver’s supervision. To support this work, ODI collected additional crash information and assessed vehicle control authority, driver engagement technologies, and related human factors considerations associated with partial automation via analysis of peer vehicle data and hands-on vehicle evaluation, assessments from NHTSA human factors subject matter experts, and reviews of related publications dedicated to partial driving automation. Autopilot is the simultaneous use of the features that Tesla calls Traffic-Aware Cruise Control (TACC) and Autosteer. TACC is a type of adaptive cruise control that, like traditional cruise control, maintains a set speed but also slows or accelerates as necessary to maintain the vehicle’s following distance from a vehicle in front. As designed, Autosteer detects lane markings and the presence of other nearby vehicles and objects to keep the vehicle in its driving lane. Autopilot is characterized by Tesla as an SAE Level 2 (“L2 system”) partial driving automation system that provides driver assistance through steering, propulsion, and braking within a specified driving environment under direct supervision of the driver. L2 systems should be designed to support the driver’s need to monitor the system in response to the constantly changing driving environment and, if necessary, take over the dynamic driving task. To ensure sufficient driver engagement, vehicles with L2 systems should employ driver engagement systems and usage controls that are appropriate and sufficient for the L2 system design and driver expectations. ODI completed an analysis of 956 crashes reported up to August 30, 2023. In approximately half (489) of those crashes, ODI found: 1.) that there was insufficient data to make an assessment; 2.) the other vehicle was at fault; 3.) Autopilot was found to not be in use; or 4.) the crash was otherwise unrelated to EA22002. Of the remaining 467 crashes, ODI identified trends resulting in three categories: collisions in which the frontal plane of the Tesla struck another vehicle or obstacle with adequate time for an attentive driver to respond to avoid or mitigate the crash (211), roadway departures where Autosteerwas inadvertently disengaged by the driver’s inputs (111), and roadway departures in low traction conditions such as wet roadways (145). ODI observed this pattern across all Tesla models and hardware versions. Crash and human factors assessment showed that Autopilot controls did not sufficiently ensure driver attention and appropriate use. At the same time, peer analysis and vehicle evaluations established that Autopilot invited greater driver confidence via its higher control authority and ease of engagement. This mismatch of weak usage controls and high control authority was evident in these crash categories, which included indications of driver disengagement from the driving task. This mismatch was also evident in roadway departures when the system was engaged in low traction conditions outside of Tesla’s recommendations.Additional information regarding NHTSA’s crash analysis is available in the EA22002 file. ODI reviewed these findings with Tesla during several conversations in Quarter 4 of 2023. On December 12, 2023, Tesla filed a Defect Information Report (DIR) (Recall 23V838) applicable to all Tesla models produced and equipped with any version of its Autopilot system. Tesla’s DIR described the functionality of this system, stated that the prominence and scope of the system’s controls may be insufficient to prevent driver misuse, and described a remedy to improve the effectiveness of driver warnings and to reduce mode confusion. ODI completed an extensive body of work via PE21020 and EA22002, which showed evidence that Tesla’s weak driver engagement system was not appropriate for Autopilot’s permissive operating capabilities. This mismatch resulted in a critical safety gap between drivers’ expectations of the L2 system’s operating capabilities and the system’s true capabilities. This gap led to foreseeable misuse and avoidable crashes. During EA220002, ODI identified at least 13 crashes involving one or more fatalities and many more involving serious injuries, in which foreseeable driver misuse of the system played an apparent role. ODI’s analysis conducted during this investigation, which aligns with Tesla’s conclusion in its Defect Information Report, indicated that in certain circumstances, Autopilot’s system controls and warnings were insufficient for a driver assistance system that requires constant supervision by a human driver. Given Tesla’s recall (23V838) of all vehicles equipped with Autopilot for insufficient controls to prevent misuse, ODI is closing EA22002. Concurrent with that closing, ODI has opened a Recall Query (RQ24009) to assess the effectiveness of the 23V838 remedy. On February 16, 2022, the Office of Defects Investigation (ODI) opened a Preliminary Evaluation (PE22002) to investigate reports of unexpected deceleration while driving with the adaptive cruise control system engaged in Model Year (MY) 2021 – 2022 Model 3 and Model Y vehicles manufactured by Tesla. The subject systems include Autopilot (all versions), Full Self-Driving (FSD) and Traffic Aware Cruise Control (TACC). These complaints have been colloquially referred to as “phantom braking”. ODI opened PE22002 to determine the scope and severity of the potential problem and to assess any resulting safety issues in the subject vehicles. The alleged defect is an unexpected and unrequested vehicle deceleration triggered by the subject system during subject system engagement. The alleged defect does not occur when the subject system is not in use and is separate and distinct from Automated Emergency Braking (AEB). During vehicle operation, AEB is actively monitoring in the subject vehicles regardless of subject system and its intervention is accompanied by audible and visual collision warnings. A Vehicle Owners Questionnaire (VOQ) trend originating in November 2021 prompted ODI to open PE22002. VOQ narratives reported unexpected brake activation while using TACC, Autopilot or FSD. The trend grew from 99 by the end of 2021 to 314 by February 16, 2022, when PE22002 was opened. ODI sent Information Request (IR) Letters to Tesla on May 4, 2022, and July 11, 2024, to request salient data to quantify vehicle production, field incidents, and the physical parameters of the phantom braking reports. ODI also requested information pertaining to Tesla’s internal assessments, problem resolutions, and their assessment of the alleged defect. Typically, the complaints to ODI and Tesla allege a 10-20 mph speed reduction at highway speeds over a 1-3 second time period.No collisions were identified. Drivers reported seeing no vehicles ahead in the travel lane that would have triggered the deceleration. Many complaints reported the conditions taking place on higher speed roadways in sunny conditions with shadows on the roadway. Complainants typically applied the accelerator to override the unexpected deceleration, and subject vehicles did not come to a complete stop or steer out of their travel lane. ODI analyzed data provided by Tesla in addition to consumer complaints submitted to ODI. Tesla’s complaint and field data exhibited some behavior that aligned with the transition from a radar-vision fusion system to vision-only in mid-2021. VOQ traffic coincided with public events such as Recall 21V846, the opening of PE22002, and several related media publications. In February and March of 2022, Tesla released firmware updates 2022.4.5.1 and 2022.4.5.17 respectively to target aspects of the subject system programming that affect unexpected deceleration. Incident traffic has dissipated substantially in the past years, with 45 incidents reported in 2024, 19 in 2025, and 3 since the beginning of 2026. The conditions reported, while concerning to the drivers, did not alter the vehicle’s lateral positioning in their lanes and did not cause significant loss in distance between the subject and following vehicle to lead to a collision. Complaint traffic to both NHTSA and Tesla reported the same conditions- vehicles traveling with the subject system engaged at higher speeds decelerating suddenly with no commensurate vehicle or obstacle ahead in the same lane. In view of these points, and a low demonstrated hazard to drivers, this Preliminary Evaluation (PE) is closed. The closing of this investigation does not constitute a finding by NHTSA that a safety-related defect does not exist. The Agency reserves the right to take additional action if warranted by future circumstances. The Office of Defects Investigation (ODI) opened Preliminary Evaluation (PE21-023) on December 21, 2021, to evaluate the driver distraction potential and use frequency / circumstances of in-vehicle game-play functionality referred to as ?Passenger Play? in certain model year (MY) 2017-2022 Tesla Model 3, S, X, and Y vehicles. Distracted driving can result in an increased risk of a crash. PE21-023 was prompted by the receipt of Vehicle Owners Questionnaire (VOQ) 11439598 from the owner of a 2021 Model 3 on November 6, 2021. ODI sent an Information Request (IR) letter to Tesla on January 20, 2022 and received Tesla?s response on March 4, 2022.On December 24, 2020, Tesla introduced Passenger Play to vehicles equipped with the Intel Atom processor (receiving an aftersale software update) via its 2020 holiday release. Passenger Play permitted occupants to play specific games selected by Tesla for primarily turn-based play style and limited gameplay motion with the transmission in Drive and the vehicle in motion. Under these conditions, a notification would display on the screen and the screen area devoted to the game would reduce from 100% to accommodate vehicle controls and driving task data readout. Specific changes varied among models. On December 21, 2022, Tesla voluntarily disabled Passenger Play capability with Firmware Release 2021.44.25.1 in response to NHTSA?s request. Tesla reported a month later that a 97% completion rate was achieved though Tesla?s Over the Air (OTA) update. ODI opened PE 21-023 to evaluate the driver distraction potential of Tesla Passenger Play while the vehicle is being driven including aspects of the feature, frequency, and use scenarios.Based on the analysis conducted, PE21-023 has been closed. The closing of this investigation does not constitute a finding by NHTSA that no safety-related defect exists. On August 13, 2021, NHTSA?s Office of Defects Investigation (ODI) opened a Preliminary Evaluation (PE21-020) to assess the performance of Tesla?s Autopilot system (a system characterized by Tesla as an SAE Level 2 driving automation system designed to support and assist the driver in performing the driving task) available in Tesla vehicles. On December 19, 2019, NHTSA received a petition from Mr. Brian Sparks requesting that the Agency recall all [Tesla] Model S, Model X, and Model 3 vehicles produced from 2013 to the present due to sudden unintended acceleration (SUA). In his petition and follow-up submissions, the petitioner identified a total of 232 non-duplicative complaints to NHTSA, including 203 reporting crashes. On January 13, 2020, NHTSA's Office of Defects Investigation (ODI) opened Defect Petition DP20-001 to evaluate the petitioner?s request. ODI's evaluation included reviews of all complaints and supporting information referenced by the petitioner, as well as 14 additional complaints to NHTSA related to SUA crash allegations that were either not selected by the petitioner or were submitted after the petitioner's most recent submission. The review also included analyses of available crash data (EDR, Tesla log data, and/or video data) the Agency acquired as part of the evaluation.After reviewing the available data, ODI has not identified evidence that would support opening a defect investigation into SUA in the subject vehicles. In every instance in which event data was available for review by ODI, the evidence shows that SUA crashes in the complaints cited by the petitioner have been caused by pedal misapplication. There is no evidence of any fault in the accelerator pedal assemblies, motor control systems, or brake systems that has contributed to any of the cited incidents. There is no evidence of a design factor contributing to increased likelihood of pedal misapplication. The theory provided of a potential electronic cause of SUA in the subject vehicles is based upon inaccurate assumptions about system design and log data.NHTSA is authorized to issue an order requiring notification and remedy of a defect if the Agency?s investigation shows a defect in design, construction, or performance of a motor vehicle that presents an unreasonable risk to safety. 49 U.S.C. ?? 30102(a)(9), 30118. Since the information before the Agency is not indicative of a vehicle-based defect, it is unlikely that any investigation opened because of granting this petition would result in an order concerning the notification and remedy of a safety-related defect. Therefore, upon full consideration of the information presented in the petition and the potential risks to safety, the petition is denied.
