The car accelerated without warning. I did not have my foot on the gas and the car just sped up. This has happened 2 times. The first time I didnt have an accident but today I did. I ran into a pole. I could have killed myself or someone around me when the car sped up. No warning. I took the car to the dealer and they admitted that there had been a recall but stated it was fixed on my car but it has not been fixed....here is the recall information 2010 INFINITI M35 Report Date: September 26, 2013 Campaign Number: 13V430000 Component: VEHICLE SPEED CONTROL:ACCELERATOR PEDAL Summary: Nissan North America, Inc. (Nissan) is recalling certain model year 2006-2010 INFINITI M35 and M45 vehicles manufactured April 4, 2004, through October 5, 2010. Over time, the accelerator pedal sensor signal may deteriorate resulting in the output of an incorrect signal causing the engine to go into fail-safe (limp home) mode. Consequence Summary: In this fail-safe mode, throttle valve deposits may cause the engine to stall when the vehicle is coming to a stop or at idle, increasing the risk of a crash. Corrective Summary: Nissan will notify owners, and dealers will replace the accelerator pedal assembly and reprogram the engine control module, free of charge. The recall is expected to begin during November 2013. Owners may contact Nissan at 1-800-647-7261

ON 5/8/15 I LEFT PAINT SHOP AND WAS GOING DOWN A DRIVEWAY (DOWNHILL) AND AS I APPROACHED STREET (RT 26 LIBERY ROAD) I PRESSED BRAKE AND MY CAR WOULD NOT STOP. I REPEATEDLY PRESSED BRAKE AND IT CONTINUED TO GO FORWARD INTO STREET. CARS WERE HONKING AND SWERVING TO AVOID HITTING ME. I CONTINUED TO PRESS BRAKE HOWEVER MY CAR CONTINUED TO GO FORWARD ABOUT 100 METERS THRU A RED LIGHT NEARLY COLLIDING WITH SEVERAL CARS AT THE INTERSECTION OF MARRIOTTSVILLE & LIBERTY ROAD BEFORE IT CAME TO A STOP. I IMMEDIATELY NOTIFIED THE JBA INFINITI DEALERSHIP AND INFINITI'S CORPORATE OFFICE WHO TRANSFERRED ME TO INFINITI CONSUMER AFFAIRS (CASE # 18774908) I WAS INFORMED THAT TO DATE, THERE HAVE NOT BEEN ANY ISSUES LIKE THIS INCIDENT REGARDING BRAKES FOR MY YEAR MAKE & MODEL (2010 INFINITI M35X). I BOUGHT A 2010 INFINITI M35X FROM A HONDA DEALER WITH 80000 MILES. DURING THE FIRST HIGHWAY TRIP I FOUND OUT THAT IT'S TOO HARD TO KEEP THIS VEHICLE WITHIN THE DRIVING LANE WITHOUT CONSTANT STEERING ADJUSTMENTS. THE CAR MOVES TO ONE SIDE OR THE OTHER IF THE ROAD IS NOT PERFECT. ALSO IF I TOOK MY EYES OFF THE ROAD FOR A SPLIT SECOND I COULD RISK LEAVING MY LANE. THIS IS A VERY UNSETTLING DRIVING EXPERIENCE. I TOOK THE CAR BACK TO THE DEALER FOR POSSIBLE WHEEL ALIGNMENT. THEY CHECKED THE WHEEL ALIGNMENT AND TOLD ME THAT IT WAS OFF AND THAT IT WAS FIXED. NOTHING CHANGED AT ALL. THE SALESMAN BLAMED IT ON THE TIRES AND STATED THAT THE PROBLEM SHOULD BE FIXED WHEN THE TIRES ARE CHANGED. THE CAR HAS GOOD TIRES AND DOESN'T NEED NEW ONES NOW. I DOUBLE CHECKED THE TIRE PRESSURE AND BRAKES AS THEY SUGGESTED. EVERYTHING SEEMS TO BE IN ORDER. THE VEHICLE HAS A CLEAN CARFAX RECORD. IN MY SEARCH I FOUND SIMILAR COMPLAINS ABOUT THE SAME MODEL CAR WHICH EXPLAINED MY PROBLEM. I UNDERSTAND THAT INFINITI DENIES THE FACT THAT THERE IS A PROBLEM AND REFUSES TO DO ANYTHING ABOUT IT. *TR

WHEN CAR IS SLOWING DOWN, IT WILL JUMP WILDLY WITH THE RPM'S AND SHIFT INTO DIFFERENT GEARS. CAR COULD HIT ANOTHER CAR OR PERSON IF THE BRAKE IS NOT HELD FIRMLY. CANNOT GET THE LOCAL DEALER OR CORP. TO ACKNOWLEDGE THE PROBLEM OR FIX IT. THE CAR IS STILL UNDER WARRANTY. THE PROBLEM IS GETTING WORSE BUT THE DEALER SAYS TO DRIVE IT UNTIL THERE IS A HARD FAILURE. I AM CONCERNED THE CAR WILL JUMP AND HIT SOMETHING OR SOMEONE. THE DEALER SAYS THERE COULD BE A COMPUTER PROBLEM BUT THEY ARE NOT SURE AND DO NOT WANT TO EAT THE COST OF A COMPUTER IF THAT IS NOT THE PROBLEM. I WAS DRIVING ON I-5 NORTH CA GOING BETWEEN LATHROP AND STOCKTON WHERE THE SPEED LIMIT IS 70 MPH WHEN MY VEHICLE'S ENGINE SEEMED TO SHIFT INTO NEUTRAL. I BARELY HAD ENOUGH POWER TO GET OFF THE FWY RAMP WHERE IT WAS SAFE TO PARK. I THEN HAD THE CAR TOWED TO AN INFINITI DEALER AND HAD THEM CHECK THE CAR. AFTER THE CAR WAS HOOKED UP TO A DIAGNOSTIC MACHINE, I WAS TOLD THAT THE RIGHT MASS AIR FLOW SENSOR-22680-7S00A NEEDED TO BE REPLACED. I WAS ALSO TOLD THAT WHEN THIS SENSOR WENT BAD, THE ENGINE GOES INTO A NEUTRAL MODE OR CLOSE TO SHUTDOWN MODE TO PREVENT DAMAGE TO OTHER PARTS OF THE ENGINE. ONCE THE ENGINE PROBLEM WAS DIAGNOSED, THE PART WAS REPLACED AND THE CAR FUNCTIONED FINE. WHAT SURPRISED ME WAS THAT THE SERVICE TECHNICIANS WERE AWARE OF THE PROBLEM. THIS CAUSES ME GREAT CONCERN BECAUSE THERE WAS NO WARNING LIGHTS TO INDICATE A PROBLEM BEFORE, DURING, OR EVEN AFTER THE ENGINE MALFUNCTIONED. THE CAR HAD TO BE HOOKED UP TO A MACHINE TO DETECT WHAT WAS WRONG. I WAS SO FRIGHTEN WHEN THIS OCCURRED BECAUSE I COULD HAVE BEEN REAR ENDED AS A RESULT OF THE CAR LOSING POWER IN A MATTER OF SECONDS. I REPLACED THE LEFT MASS AIR FLOW SENSOR BECAUSE I DON'T WANT TO EVER BE IN THAT SAME SITUATION AGAIN. I DON'T FEEL SAFE DRIVING THIS VEHICLE! *TR

VEHICLE STEERING SEEMS TO HAVE ITS OWN MIND AT ALMOST ALL SPEEDS AND TENDS TO LUNGE FROM ONE SIDE TO ANOTHER REQUIRING CONTINUOUS CORRECTION. THE WHEELS SEEM TO FOLLOW MOST EVERY DEFORMITY / IRREGULARITY OF THE ROAD. ONE INSTANCE THE VEHICLE MOVED OVER FROM ONE LANE TO THE MIDDLE OF ADJOINING LANE ALMOST CAUSING A CRASH. WHEN STOPPING THE STEERING CAN SWING UPTO 45 TO 60 DEGREES IN EITHER DIRECTION. HAVE TAKEN THE CAR TO THE DEALER MORE THAN THREE TIMES - FIRST TIME WITH 18000 MILES ON THE CAR. HAVE ALWAYS BEEN ADVISED THAT EVERYTHING WAS NORMAL. RESEARCHED ON WEB AND FOUND MANY SIMILAR COMPLAINTS WITH THIS MODEL CAR DESCRIBED AS 'TRAMLINING'. LAST TIME I TOOK A PRINT OUT OF NUMEROUS SIMILAR COMPLAINTS FROM THE WEB TO THE DEALER BUT THEY STILL REFUSED TO ACKNOWLEDGE THE PROBLEM. THEY SAID THERE IS NO SOLUTION OFFERED BY INFINITI FOR THIS PROBLEM AND RECOMMENDED TO CHANGE THE TIRES. HAVE CHANGED THE OEM TIRES AT 26000 MILES, DONE ALIGNMENT THREE TIMES, BRAKES SERVICED BUT THE PROBLEM PERSISTS. HAVE REPORTED THE PROBLEM TO THE INFINITI CUSTOMER SERVICE AS WELL BUT NO SOLUTION OFFERED. I FEEL INFINITI IS DENYING TO RECOGNIZE THIS SERIOUS PROBLEM WHICH HAS THE POTENTIAL TO BE A MAJOR SAFETY ISSUE. *TR

MY LEASED 2010 INFINITY WITH 245-45-RSA 18" TIRES INSTALLED. IN 14000 MILES TIRES HAVE SUFFERED 3 LOW PROFILE TIRES WITH SIDEWALL DAMAGE DUE TO STRIKING POTHOLES REQUIRING REPLACEMENT.HAVING DRIVEN 60YRS AND OVER 900,000 MILES EXPERIENCED ONLY ONE TIRE SIDEWALL DAMAGE WITH BUBBLE/RUPTURE IN ALL THAT TIME. HAVING BEEN INVOLVED IN AUTO RACING MY DRIVING SKILLS ARE BETTER THAN THE AVERAGE DRIVER.I AVOID AS MUCH AS POSSIBLE POT HOLES BUT IT IS INEVITABLE TO CONTACT SOME. I ALSO TRY TO SLOW DOWN AS SAFETY PERMITS SO AS TO HAVE A LOWER IMPACT ON SAID POT HOLES. STILL 3EA.TIRES IN 14000 MILES ARE DUE TO THE "LOW PROFILE TIRE DESIGN" THE SHALLOW ASPECT RATIO IS THE CULPRIT. AS A FAA LICENSED AIRCRAFT & ENGINE MECHANIC AND FAA LICENSED PRIVATE PILOT I AM QUITE FAMILIAR WITH A WALK A ROUND NECESSARY BEFORE A AIRCRAFT IS FLOWN,I ALSO APPLY THIS TO THE TIRES ON MY VEHICLE. IF THERE IS A BUBBLE OR SIDEWALL DAMAGE THE POTENTIAL FOR A "BLOWOUT" ON THE HIGHWAY AT SPEED WITH ONE'S SELF , FRIENDS OR FAMILY FOR INJURY OR DEATH DUE TO A TIRE BLOWOUT EXISTS. MY OPINION IS THAT LOW PROFILE SHOULD BE SOLD ONLY ON LIGHTER WEIGHT SPORTS CARS AND IN AREA'S OF THE COUNTRY WHERE POTHOLES ARE NOT SEEN.IN OTHER WORDS WARMER CLIMATES CAN HAVE LOW PROFILE TIRES AND COLDER CLIMATE AREA'S SHOULD NOT UNLESS REQUESTED BY THE DRIVERS OF CARS THAT MAY BE EQUIPPED WITH THESE TIRES ON A REQUESTED BASIS. PLEASE LOOK INTO THIS ALL TO COMMON PROBLEM AS THE TIRE MANUFACTURERS MAKE MONEY REPLACING THESE TIRES AS DO THE NEW CAR DEALERS AS THE RETAILER OF THESE DANGEROUS TIRES.I SHOPPED FOR THE LAST TIRE REPLACED AT MY EXPENSE AND THREE TIRE RETAILERS STATED THEY REPLACE A ABNORMAL AMOUNT OF THESE TIRES DUE TO THE SAME REASON. *KB

CHECKED THE COMPUTER READ OUT, ROAD TESTED THE VEHICLE FOR 70 MILES, AND INSPECTED IT THOROUGHLY BUT COULD NOT DUPLICATE THE PROBLEM. MY FRIEND TRIED TWICE TO APPLY THE BRAKE AND ACCELERATOR PEDAL SIMULTANEOUSLY BUT COULD NOT DUPLICATE THE PROBLEM THAT I HAD. ON EACH OCCASION, I WAS SCARED TO DEATH AND WAS SHAKING AND SWEATING. Risk: An inflator rupture may result in metal fragments striking the vehicle occupants resulting in serious injury or death.
Remedy: Nissan will notify owners, and dealers will replace the passenger frontal air bag inflator, free of charge. The recall began December 21, 2017. All owners should receive a second notice by May 15, 2017. Owners may contact Nissan customer service at 1-800-647-7261.

Investigations
1 NHTSA investigation on record
Investigations are agency reviews, not findings that a vehicle is defective.
From 2000 through 2017, Takata produced millions of air bag inflators using two types of phase-stabilized ammonium nitrate ("PSAN") propellant -- propellant 2004 and propellant 2004L. After prolonged exposure to high temperature cycles and humidity, inflators using propellant 2004 can degrade, causing the propellant to burn too quickly when ignited. The rapid burning can cause the inflator to rupture during deployment, potentially causing serious or even fatal injury to vehicle occupants. See 2016 Blomquist Report at www.nhtsa.gov/sites/nhtsa.gov/files/documents/expert_report-hrblomquist.pdf.Consequently, all frontal inflators using propellant 2004 that do not contain a "desiccant" (a substance that traps and holds moisture) in US vehicles are under recall. These "non-desiccated" inflators either have been or are required to be replaced. In some cases, the remedy part for these recalled inflators was, or will be, an inflator using either propellant 2004 or 2004L that does contain a desiccant. None of these "desiccated" remedy parts (which were installed in older model year vehicles) are currently under recall for a degradation concern. Certain subsets of desiccated PSAN inflators using propellant 2004 for use as original equipment, however, have been recalled for a degradation concern. All Takata inflators produced with propellant 2004L contain desiccant, and none of these desiccated inflators using propellant 2004L are under recall for a degradation concern. There have been no reported field ruptures in any non-recalled desiccated PSAN inflators. It is understood that desiccants fully saturate at some threshold, at which point any additional moisture will not be captured. This means the degradation process observed in non-desiccated inflators using propellant 2004 may also occur in non-recalled desiccated inflators using propellant 2004, assuming additional moisture enters the inflator and high temperature cycling occurs. Based on available information, desiccant saturation can occur within the first five years in the worst environments, and the time required for full saturation is affected by multiple factors. While no present safety risk has been identified, further work is needed to evaluate the future risk of non-recalled desiccated inflators using propellant 2004.Three entities -- Takata (now known as TK Global), the Independent Testing Coalition, and Exponent -- have been studying the long-term behavior of Takata desiccated PSAN inflators using propellant 2004L (as well as 2004) in the presence of moisture and temperature cycling. The research efforts, which include development of predictive modeling techniques and field sample analysis, are ongoing. To date, none of the researchers have identified field evidence showing that propellant 2004L is undergoing a degradation process that leads to aggressive deployment and potential rupture. However, the time in service of such inflators remains short compared to that of the inflators using propellant 2004. Further study is needed to assess the long-term safety of desiccated inflators using propellant 2004L.The Office of Defects Investigation is opening this investigation to examine whether a safety defect related to propellant degradation exists in non-recalled desiccated PSAN frontal inflators manufactured by Takata. This investigation will require extensive information on Takata production processes and surveys of inflators in the field. Lists of recall actions that may have used desiccated PSAN inflators as remedy parts, as well as the makes and models originally manufactured with them, is available with the downloadable version of this document (see nhtsa.gov/recalls?nhtsaId=EA21002 -- note this information is subject to change/revision as the investigation proceeds). This investigation does not supersede EA15-001, which remains open.
